    Bye Bye Baez? NO! Read the motion

     

     

    A Michigan inmate has asked Judge Perry to have Jose Baez removed from the case.

    This morning, April 5, the Orange County Courthouse issued this statement regarding the motion filed yesterday with the Clerk of Courts:

    Please see attached Motion (Defendant’s Motion for Withdrawal of Appointed Counsel) in the State vs. Casey Anthony. It is not filed by Casey Anthony.

    It is filed by an inmate in Michigan.

     

    He also wrote a letter to Linda Drane Burdick on June 8, 2010.

    Hi Dave - At first I thought it was Simms but after reading your great article I think it is Mason. Some are saying Mason has had prostrate cancer in the past so maybe he is ill. Finnell could be well qualified to take his place as a DP lawyer. If that is the case I do not think it will slow things down unless Finnell does not want to do it.
    What would happen if Casey fired Baez? Could she do this now?

    Hi Nika1 - Yes, Casey could fire Jose, but the judge could rescind it, especially this late in the game. It's the word "appointed" that leads me to Baez and Mason. My choice is merely my educated desk. I just don't think his heart is into it, but I've been known to be wrong before. If it's a health reason, the judge would allow it. For any other reason? I doubt it.

    Dave, it's a good thing you had a question mark after Bye Bye Baez. I let out a gasp when I first saw your post. I mentioned earlier at my sandbox that it may come as a shocker if it was Mason. It does not surprise me since the man does not appear to handle defeat very well.

    I don't know what to think right now.

    Cheney Mason filed motions that he knew darn well would be denied. If it is Mason, I am not going to shout, "I told you so." but I will whisper it.

    Hi Dave,
    Who appointed Baez? Why would a non death penalty qualified lawyer be appointed to be chief counsel in a death penalty case? Is Mason only there because he is death penalty qualified? I don't think he is having the fun he had fantasized it would be.

    Judge Strickland told Baez he couldn't leave. That's tantamount to an appointment in my opinion.

    Ann Finnell is DP qualified and no, Mason is not having fun.

    If we are talking "appointed" then my bet would be Mason. Otherwise, its Sims. Baez is as adept as she is in cross-examining the experts. I guess you could say I wasn't too impressed with her.

    I apologize for not knowing at what minute the sidebar takes place-it was begun shortly after this video began. They talk of scheduling the next Frye hearing. OT-Baez makes a joke with the judge of which HHJP does not find amusing. The judge did direct some chatter with Mason and it sounded like HHJP said something about Down's Syndrome. That could be my bad hearing, though.

    I really don't know what to think. It could be Sims, but I keep coming back to this "appointed" word and that brings me back to Mason and Baez. I couldn't hear what JP said to Mason, but I could clearly tell he was addressing him.

    @Frankie: At the time that Casey hired Baez, it wasn't a death penalty case. And you're right, I don't think that Mason is having much "fun" these days.

    Common sense tells me it is Mason leaving....particularly after his childish behavior of late.

    Doesn't it seem Mason and Casey have been pretty chummy of late though?...and Baez has been avoiding much contact with his little fame maker client....could it be trouble in paradise? I guess we have to wait to see. Delay tactic? Possibly....will it work? Probably not! I sure hope not!
    Where did you see the motion and brief were filed? Scooped the msm again did ya Dave? LOL

    I think it will be Mason who will be leaving. He doesn't appear to be a "happy camper" for some reason. Who knows, it could be health related.

    I just hope the trial will NOT be delayed! It has gone on far, far too long as it is. Please say that won't happen. Please.

    Bet the Anthonys are "all ready" to hit the Media Trail as soon as a verdict is in!

    According to WESH it is Baez mentioned in the motion. Speculation as to the reasons why could take multiple different directions, however I think it is solely because Baez is finally realizing he is in over his head and knows Casey is guilty, and because so far all his efforts to hide evidence has failed he's deserting the sinking ship.

    I just saw on WESH that it was JB that KC asked to have removed, but as you stated, Judge Strickland said that he would have to stick to the bitter end! But, if she asks for him to be removed and it is not allowed I am sure that will bring an appeal when she is convicted. This case can't get any crazier! I will need a large bowl of popcorn, a bottle of asprin and a few bottles of beer to get thru the hearing tomorrow. I pity you sitting in on it, but I also envy you getting to see the fireworks first hand.

    Yup, this case can't get crazier, and neither can some of the inmates.

    This just in from Wesh News. It appears this is a letter written on casey's behalf from an inmate in Michigan. Just another nut job trying to interject himself into this case. Oh well kept us all on edge for a quick minute didn't it?

    Thankyou as always, for all that you do for all of us. I saw that you were very tired and still yet answering our many questions. Get the much needed rest and we will all be waiting. Your health is much more important!
    Now...........I just listened in on In Session. I don't understand. An inmate has asked for Jose Baez to be removed? When there is a chance, can someone explain all this? CONFUSING! My mind tells me it is a set up to delay the case. Snoopy? Do you know anything?

    The document is not binding. Only people affiliated with the case, i.e., defense attorneys and prosecutors, can file motions, so Curtis just wasted time - his, ours and the court system's. What a strange bird he is.

    The line of storms past through here early this morning Dave and they were severe. Two trees down but at least not on me or the house. Stay safe!!!

    We got some heavy rain and strong winds, but it wasn't as bad as it was supposed to be. I hope you're OK. We lost power for a short while, but no fallen trees.

    Actually I do not think the inmate is crazy. He has a very good point about Jose ineffective counsel.... Curtis is only pointing out the obvious. Jose has had over 2 years to come up with a defense for his client yet at the moment he seems to have nothing. I betcha if there really was a nanny Casey would want all the evidence to come in. I doubt any of it would be junk, the duct tape would be heinous etc. To bad this inmate could not represent Casey she might actually have a chance to get lwop, Jose is going to get her the needle. jmo

    Quite frankly I'm glad our media got a much deserved "smackdown" except for the Orlando Sentinel...I think they waited before going public. There has been far too much time spent speculating as to what the facts are. Speculation and analysis as to the outcome of the facts are one thing, but to speculate as to what the facts will be and causing a firestorm are another. This is exactly what Jose Baez has been screaming all along. What appears to be factual and obvious, is not.

    Fact: motion filed: defendant's motion to withdraw attorney
    fact: we don't know what this means, we'll have to wait and see
    fact assumption: Casey must be firing someone!

    Fact: defense added a witness who had an altercation with George
    fact: no one knows why, we'll have to wait and see
    fact assumption: George killed Caylee

    Fact: bar complaint against Jose Baez and Brad Conway interview released
    fact: we don't know who filed it, we'll have to wait and see
    fact assumption: It must have been filed by Conway

    you would think TMZ owned some of these media outlets!

    Fact: We got duped, but yes, it did seem like TMZ.

    I believe this is the second letter that this guy has written to the court. He must be reading law books because he got a lot of the terminology that lawyers use right. He also wasn't far off on why Baez shouldn't be representing Casey any longer. For those of us who thought it was Baez that was leaving wasn't that far off because he was mentioned in the letter and he is the lawyer that was basically "appointed" as her attorney when she was declared indigent. Nothing like trying to keep us on our toes.

    Yes, Dave, I agree, the word "appointed" got my eye...Since neither Baez nor Cheney were "appointed" I knew it could not refer to them and I thought it was some sort of April Fool's Joke...This Mr. Jackson is looking to hop on the great circus wagon and attain his moment of fame...Perhaps he is penpals with Casey...Could he be holding "notes" that she is displeased with her counsel??? I don't think so...Just another strange and interesting twist in this case...

    It sure was "appointed" that originally threw me off, along with almost every media giant. Fortunately, his letter is worthless, but he sure did fool us.

    I love all the speculative comments about which attorney ws leaving. Exactly NONE of you folks got it right. Perhaps you all should let the proceedings move forward without your amateur attempts at convincing others you have some special insight. Much like the online chat boards during the hearings, you people essentially treat this terrible event as your own personal entertainment.

    As Casey Anthony's murder trial approaches, a new level of weirdness has settled in around the case: A recent wave of obsessed court watchers and fanatics have tried to inject themselves into the story, only adding to the circus atmosphere.

    The latest example is Michigan prison inmate Curtis Jackson, whose handwritten motion filed late Monday asked for defense attorney Jose Baez's withdrawal from the case. Jackson's claim— that there was "an attorney-client breakdown" between Baez and Anthony — caused a brief media frenzy. Baez quickly dispelled that notion during a lengthy interview on national television Tuesday.

    "He writes all kinds of things from having knowledge about the case and having knowledge about what actually happened to Caylee," Baez told In Session, while explaining the parties in the case have heard from Jackson before. "There's absolutely no way he has any connection to this case, ever."

    Like it or not, experts say, Casey Anthony has developed a certain "celebrity" thanks to the intense media coverage of her case and her relative attractiveness. And that status, in large part, helps draw admirers, unofficial advocates and trial groupies all looking to share the spotlight.

    "You could see how she [Anthony] could be very appealing to people around the country," said Jack Levin, a professor of sociology and criminology at Northeastern University in Boston. "Many are enamored of people who have achieved this level of celebrity regardless of why

    Dave,Baez told In Session this morning that he would address the # 31 days in the first one minute of his addressing the Jury and it would be laid to rest forever. It surely must be powerful stuff to have that result. He was full of praise for Casey and said she was very involved in her case.Can't wait for the 31 day explanation. Have a good day tommorrow.

    You know what bothered me most about this filing? The inmate is in a MAXIMUM SECURITY prison and he has Casey's case information down to the last number. Now we all go online and watch it on tv but how many of us notice or can even repeat what her case number is? My daughter used to work as an operator in a prison so I know they have a list of who they can call.. I would only assume it's also who they can get mail to and from. Among those are their own lawyers. I wasn't aware they could petition the court on their own or someone else's behalf. Who was checking his mail and how did this happen? From what the article about it said JP can cut his contact with the courts.. I'm wondering how he had it to begin with! If it can be done then a law should be passed to prevent it. And if it was mailed to a friend who did it for him then they should be told it can only be done by the defendant herself.

    This whole thing bothers me and it has nothing to do with the press bias one way or another.

    Baez going on InSession only proves he thrives on the media attention. He could just issue a written statement and let it go but nooooo he has to go on tv to give more media attention to his client. The only ones not griping about all the media is the prosecution and they don't have to because Baez is burying his client on his own.

    Ecossie, when Casey ran out of gas and called Tony who broke the lock off the shed with a tire iron.so Casey could get the gas..... the name of the street was Anthony Ave. Anthony Lazzaro, Anthony Rusciano.... Tony wasn't familar with the area around Hopespring so LE drove him around so he could see if something looked familar....sure enough... he said that he was almost positive it was Anthony Avenue.     I don't envy you sitting in that courtroom all day long. Even with breaks it's tiring. At least when I watch it online I can (and always do) play a game while I'm listening to it. That way I don't have to watch all the Casey-is-organizing, doodling-shots. Btw.. don't want to curdle your cheerios but the game I play is called.... wait for it... WORDSLINGER.     Oh my goodness, I found inmate Curtiss's filing hilarious. An out-of-state maximum security inmate can cause this much ado about nothing. Who I am curious was the first idiot to report this as a fact?
    As to those who believed such a thing, WTG, nothing wrong with you until you had a chance to see if it was true. With the way the case has gone absolutly anything is possible and probably will occur. Murphys Law runs rampant throughout this event.
    Who would have thought the State of Florida is rooting around for money to finish this trial?

    Marinade Dave's blog existed long before Miss Anthony had become a topic. Dave lived near this news story and with most of his online friends living a distance away, he was encourged to keep us informed. As he became interested for us, we that lived out-of-state recieved less news about the Anthony case, Dave became our source.
    DAVE TOOK THAT RESPONSIBILITY SERIOUSLY AND TRIED TO GIVE US UNBIASED FACTS.
    HE TOOK PHOTOS AND VIDEOS OF THE AREA SO WE COULD UNDERSTAND BETTER.

    This case has a life of its own with all the historonics that encircl it. The collateral damage, volume and variety of people involved, the actions of the Anthonys, and the caliber of attorneys at one time that were involved became the story, not little Caylee. Many here try to keep Caylee in mind.

    So James, please come back any time, all of us crazies will be waiting to welcome you.

    I could have sworn it was going to be Finell! The jokes on those of us who bought the tale, hook, line and sinker! You didn't, though, did you Dave?

    Isn't there something familiar about Mr. Jackson's handwriting? It reminds me so much of Casey's. Do all felons forget to dot their i's and curve their k's and curl their a's and make their f's look like sheep herders staffs? Just kidding!

    I can't wait for your write up on yesterday's hearing. The sound was so bad that I gave up after about an hour so missed the majority of it,

    Would you know if there's any truth to the rumor that Baez gave Cindy the business about the clothes that Casey was wearing, and if Baez and Casey had some sort of tiff? They didn't seem too friendly toward one another from what I could tell during the short time I watched. Actually, I thought her outfit was rather cute, however inappropriate for court. If she would have done something with her hair, maybe it wouldn't have come off as badly as it did. She's not bound to dress like that again, eh?

    I did see you in court and waved, but you didn't see me. I was the blond sitting in the balcony - overlooking Miami Beach. ;-)

    James, this is all but entertaining. There isn't one of us who doesn't wish this wasn't happening. We come, we watch, we read, we listen, we learn, we share and we make our mistakes along the way, but we do it all because more than anything we want justice for Caylee. She doesn't just belong to the Anthony's any more, she belongs to every one who has ever wept for her, feared for her, longed for her, hoped for her as deeply as we hope that justice will serve her, and serve her well. Certainly you can understand that, can't you?

    I've got to be honest, Feathers, I fell for it at first, just like everyone else. Except for Tony Pipitone. We were all quick to remedy the situation, though, and if I'm correct, Anthony Colarossi from the Sentinel was the fastest.

    I don't think Baez gave Cindy a hard time in court. They seemed fine. We have to be careful because one person will allege something and suddenly, it turns into a tidal wave of misinformation.

    I'm going to do a write up on the Frye motions, probably tomorrow. I'm going to skip the hearing and watch it at home so I can type up a story. I've been extremely busy lately and that's kept me from doing what I do best.

    By the way, I looked out the courthouse windows and I couldn't see Miami Beach. You must have had a great view.

    Oh come on Dave are you really going to keep us in suspense that long to find out why you haven't been around lately?? Curious minds want to know!! Have a great Friday! (Thursday is almost over)

    For now, Janet, yes... I'm going to keep things quiet. After I write about the Frye motions, I may mention what's been happening in my life of late. Next week, probably. Meanwhile, I do have some serious writing to do. Thanks, happy Friday to you, too.
