Just to let you know...
I have my moments when I’m not feeling well and I’ve been like that off and on for the past few days. I’m OK, though, and it’s not something I want anyone to worry about. It comes and goes and I’ve had this condition for years.
I’ve also been having some rather annoying problems with the laptop of late, but after I spent hours & hours trying to diagnose and repair it, it turned out to be a glitch in Google Chrome, my main browser. I ran ScanDisk, too, searching for System Errors and Bad Sectors. I uninstalled Chrome and downloaded a fresh version.
Today, we had long time family friends over and I felt this would be a good time to try to fix it. Nope, it didn’t work, so I am using another browser. Tomorrow, I will be on Simon & Jan’s show, Lord willing and the creek don’t rise. Meanwhile, there’s an issue I will discuss sometime during the week of April 18 pertaining to the trial and my coverage of it. All I will say now is that the “Marinade Dave” blog did not get media credentials, but there’s a very good reason why. I never requested them.
Trust me, it’s all very good. Thank you for being so patient. I promise you, a new post is coming.

thank you Dave for the update...i do watch the gallery and looking for your face during the live feed...it is reassuring to see you and others that we trust sitting behind the State's table..only a few weeks before trial...i am waiting to see where the first jury pool is going to be pulled from. I hope we don't have to drag this out, Baez is going to get his fingers broken if he doesn't stop clicking that pen...very annoying...we hear it very loud and clear on the feed, can you hear it in the courtroom. I hope Judge Perry will begin to fine him $100 per click....BAM...there is not enough money at the ATM for all those clicks.....jmc
Thanks, pinkbunny. I'll tell you, those benches in 19D sure are uncomfortable. I can't wait until we go back to the 23rd floor. It's hard to believe it all starts in one month. Personally, I think the judge should move an ATM into the courtroom just for the intimidation factor.
Well, Dave, I was starting to fear a diabetic coma there! All that sitting for long hours in a courtroom can't be good for your health. But then that's on you, so I'll leave it to you. Good to know you're back and I'm looking forward to the next article.
I had the same issues only with IE8. Now that the new versions are out, the old ones have glitches it seems. I tried and tried to upgrade to IE9 and eventually had to go to the website and find the version that's compatible with my version of Vista. It seems the newer upgrades aren't going to be very good with WindowsXP either. I tried Chrome and didn't care for it. The new IE9 looks similar to Chrome .. all the similaries are the ones of appearace that I didn't like with Chrome lol. Oh well. Simple upgrading just isn't as easy as it used to be.
God forbid I ever fall into a diabetic come. When I went on Byetta just over 2 months ago, I had to learn how to adjust it, along with the Lantus and the other 2 medications. Fortunately, I can feel it when my sugar drops too low, and it has awakened me from a dead sleep. I cut my Lantus by 25 units and that seems to have fixed the problem. Diabetes is not fun.
I have about over a dozen browsers on my laptop that I use for different functions. Chrome has been my mainstay, but when I try to download something, I get a message: The file name is not valid. Nothing has fixed it, so I just use anaother one.

As much as we all wait in anticipation for your posts, I'm sure we all agree that your health is priority #1.......for not just you, but for your parents as well as all of us.
I totally agree with Mary Jo that any of your posts are worth waiting for.......and, I am another one whose curiousity has been peaked about April 18.
I am getting close to the end of my patience with these KC hearings......and the constant whining and droaning on and on about the same things.......and I pity you having to sit there all day listening to it all........Am sorry to hear that you did not get a media credential for the trial but, I think it would be a lot of extra stress for you........a hearing now and then is one thing but day after day for a month or more would be just too too much for you!

I'm researching a case in Florida where a murderer was caught in 1995. He was sentenced to death in 2000, five years later. That's two years longer than Casey's. In December of 2010, he filed a Petition for Writ of Habeas Corpus with the United States District Court, Southern District, which is pending. This is 16 years after his arrest. If Casey is convicted and sentenced to death, it will be a long time before the punishment is meted out. I'll most likely be dead before she is, but trust me, I'm in no hurry. Thanks for caring!

Who knows what the trial may bring, but I can tell you I will be reporting on it unless my health becomes an issue, which I do not believe will happen.

What a time to have computer issues....bummer! I have downloaded Google Chrome on my desktop but haven't used it yet.....Mozilla has been working fine..so...not broke don't fix it....but I do have that backup ready to go....just in case :)
Started making plans today to visit FL the first week of June. Hope the big trial has started by then. I know it will be hard to get in, but no way can I be so close to Orlando and not try.
Hope you are up to the radio show tomorrow...you would be missed if you didn't make it. I finally figured out why I wasn't getting reminders from BTR. When I changed e-mail accts a while back I changed my BTR account but I looked around last week and found my old e-mail was still on the reminder section. DOH! Hopefully I can be on time this week :)

Hi katfish - Chrome is a very good browser and it's become my workhorse. Unfortunately, I can't fix it, so I have two other browsers that are based on Chrome. Chrome is Google's, but it's not proprietary. In other words, it's open source software. I could write my own version of it if I want to. I'd call it Chrome Dome.
If you come down in June, let me know when and I'll do my best to meet up with you. I'd enjoy that!
I do plan on being on the show today because I enjoy doing it. I rarely get into a funk where I'm incapacitated. It's just an overall achy feeling and it's tough to write when I feel this way. I do hope to see you there!

I used Google Chrome for along while and then it began to act up with my Windows XP, so I had to go with Mozilla Firefox. I don't like it as well, but I no longer have the issues and glitches.

I have a lot of good software protection on my laptop, and I didn't think it was a virus of any sort. My other laptop is dedicated to my phone and I never browse the Internet unless I have to, but if anything ever happened to this one, at least I have a back up.

Glad you are feeling well enough to do the show today. I know what you mean about the difference in doing the show vs. writing when not feeling up to par......for me, writing requires full concentration and that achey feeling is a distraction.

Hi ecossie possie - Thanks for worrying. I just go through these bouts of weakness and aches. I always manage to pull out of it, but it's still a pain. I do help my parents more and more now, and it's the least I can do. They know I'm here for them and it's reassuring.
If you have trouble downloading or installing software, try turning off all of your virus/spyware/firewall programs. That may be the culprit that's stopping Google Earth. I can't say for sure, but it's worth a try, but don't forget to reactivate them.

Just had to bring this up. Have you heard about the CBS 48 HRS. that is coming on next week....(I think next week, will have to ck.) Anyway, a huge number of attorneys are getting together, ALL saying that Casey should be acquitted for LACK OF EVIDENCE! I am really upset about it, as are alot of other people that believe she is guilty.

Airing this program just before they want to try and panel a jury is ludicrous. Baez was the one who was belly aching that Casey was being tried by the media. Well what in hell is the defense trying to pull here? They are having the dang trial before they have even picked a jury. I read some of the comments at Hal's link and most are as riled as I am.

Dave, sorry to hear you've been under the weather. Diabetes sucks. Do you mind sharing what your HBA1c value is? Also, do you wear a medic alert bracelet? I highly recommend one. For my fellow posters, Dave is right. Diabetes it is a terrible illness, and unfortunately, in the early stages, you might not even know you have it. If you are overweight, lead a sedentary lifestyle, are over 40 years of age or have a family history, be sure to get your blood sugar checked on a regular basis to catch it before it has a chance to damage your nervous and vascular system. Diabetes HURTS. And when it's poorly controlled, it can kill you. Be good to yourselves....Rusty
Hi Rusty - My A1c has been running in the low sixes. Once, it got up to 6.4, but it's never been higher than that. Not bad, actually, but I'm on a lot of meds. I do keep a diabetes medic alert bracelet on my key chain. One of the courtroom deputies told me they are all trained to determine if a person is going into a coma. I told him about my key chain and he said they look at wallets, bracelets, pockets and keys, so mine is in a good place.
Thanks, Rusty, that's great advice. A lot of people have no idea what a diabetic goes through. No two diabetics are the same, either, so there's no way a person can take someone else's medications. Besides, prescriptions are written for one person, not two or more. I have an appointment with my doctor tomorrow and I have a few questions I want to ask about the type of insulin I'm taking. Lantus is very good, but I'm having problems keeping my numbers in check. They sometimes run too high, but at least my morning number is completely under control.

Dave, the blog radio show was, how shall I put this? Mediocre would be about right. I would rather have been helping Cobra put in his plants. He is one busy man and his attention seemed to be focused on his task at hand and the radio program was secondary. Denny made some very good points about all the bits of evidence amassed together will make a huge impact.
Am I to understand that Simon could not access the chat room? There was a couple disrupters who had free reign and it was very irritating to say the least. I did lose my cool and told one of them to shut up so I guess that person won and I lost. Hopefully next week they will be staring at a blank screen.
Well we have a hearing on Friday of this week and the 48 hour show on Saturday. I do hope the state makes some waves about that show. If the shoe was on the other foot and 48 hours was airing a program on how very guilty Casey is, we would hear some loud screaming from the defense.

At the end of this video people are asked how many people would vote to acquit and it looks like all but one would.
I hope JP ends up bringing them back to Orange County to pick a jury. The defense will not be able to fight it because they are the blame for all the media this case has gotten. They are the ones that are going on TV trying to taint the jury pool. They will get what they deserve.
Mary Jo, what is that old saying, "there is method in my madness"? This is just an excerpt of a comment that was left on my blog. It is worth sharing. Judge Perry is one smart man and nobody's fool.
After JP made the announcement that if a jury can’t be selected from the “surprise” location, that he would bring them back to Orange County. I got the impression that it was a subtle warning from JP that the attorneys had best not screw around or else they will have to take what they can get from their own back yard.
Snoopy, I think JP was telling them them in a subtle way that they better either pick a jury in a week in the county he chooses or else they will pick one from where they don't want to. I wonder what his thoughts are regarding the defense doing the 48 Hours Mystery show. I don't think he can be too happy about it, and I don't blame him. This defense won't have any good arguments to give JP if he comes back to Orange County, especially after doing 48 Hours.
When Judge Perry made that announcement about coming back to Orange County, the look on Cheney Mason's face was priceless. He became a bit pale and mumbled something. I think you will find that Mason will be taking over when they go to panel a jury. He is a pro at this and hopefully, Baez will step back and let Cheney do his thing. If Baez insists that his input is needed, God help them all.
Judge Perry has watched these two sides perform and knows that they cannot agree on anything. They want to be able to have a jury picked, in this secret location, by Thursday, May 12th. Judge Perry is telling the defense and state of the location on May 2nd and then they get to discuss this on May 4th. Now will they agree? Baez announced some time ago which counties he preferred and I have a feeling that the judge did not choose any of them. It would save alot of travelling and accomodation costs, if the jury could be picked in Orlando but I do not foresee that ever happening. If the jury does come from Orlando, the costs for sequestration will still exceed $350,000 when it is all tallied up. Time is of the essense and the trial is forecast to start on May 17th now. It will be a miracle if that can be achieved.
An after thought...
If Baez had gotten his act in gear back in 2008 when he had plenty of funds available, this trial would have been over ages ago and Casey would not have been facing a death penalty on the table. Terry Lenamon offered Baez sage advice but Jose was too busy basking in all the glory. Baez would never admit that he was gambling with his client’s life at the time.

Yup, Snoopy, they made a botch of this early, early on. Now, they're stuck with a bunch of things that have already been ruled in and having to work with whatever clay Judge Perry's future rulings will leave them with. Clearly Baez is thinking to undercut the impact that another pile of denials will leave their side with, in the Public's eyes. So he's gone on the offensive, beating on the Drum of Doubt, and a promise to answer the "31" days Bad Fact "in the first five minutes". So we gotta figure with that number of lawyers strategizing away like crazy someone, maybe even Baez himself(!) has dreamed up a semi-plausible explanation for that and how the duct tape is over the nasal area of the face and NOT mean Murder 1.
Well, when you look at this entire case it's quite obvious the investigation could've been a lot cleaner. They only focued on one Anthony which is and was a major booboo.
I think they focused on Casey because she was the only suspect. She was one giant lie. But trust me, the entire family was investigated for many reasons. They were never suspected in Caylee's disappearance and murder. Every piece of evidence pointed to one person and she's sitting in jail.
I am troubled by the recent video showing Baez and Casey doing some "not so nice things" in Judge Perry's courtroom. Do you think anyone will send this video to Judge Perry. I just could not believe how unprofessional this was. Even Mr. Mason sat by and let it happen. I have personally thought about sending a copy to the court in Orlando. Just wondered what you all think about it. I don't think Judge Perry would be happy at all about this......by the way, he seemed to be very short with everyone last Friday......do you think he has already heard about the video and maybe even seen it??? Very sad indeed! A baby is dead, and the mother is acting like Lindsay Lohan!! And her attorney, well "Disgusting" is the word that comes to my mind. I appreciate any insight you can give me concerning this. Thank you!
I say, go ahead and send the video, but if the judge didn't see it at the time, he probably won't address it. I noticed right away on Friday that he was a bit short, but I can understand why. Those Frye hearings took way too much time and he was growing weary of the back and forth between Baez and Ashton.

One of these days, Judge Perry will say enough is enough because it's too close to trial. It is what it is... that's one of his sayings.
Good morning Dave and everyone. Dave I am really sorry that you are still not feeling well. I think what concerns me the most about you is that with the trial getting closer and closer, there will be more hearings and then put the weeks of the trial on you. How can your health hold up to all that pressure? I love your reports and your feelings on the hearings but I would hate to think that our wanting to know all the details will make things worse for you. I can not imagine you staying away; you have so much time invested in this trial. I guess there has to be a happy medium some place for your health to not take a nose dive. I will keep you in my thoughts and prayers. We are a selfish bunch here and we not only want you well but your reporting on the hearings and up coming trial.
I was not home yesterday so I was not able to listen t o the radio blog. I had problems last week getting into the chat so I just listened. I have decided to just ignore the chat for now at least until the trial starts. There may be only a few of "them" in chat but they make discussing Simon's show hard. Hi Peggy - It's going to be a tough two months on me, but this is what I've been working on for the past two-and-a-half years. The end is drawing nigh and I must remain strong to cover the trial. I have no choice. Once it's over, I may take a short break from the blog, but not until then.
The "thems" are just as idiotic as ever. They have zero respect for anyone, including themselves. They are resorting to trashy e-mails threatening of impending doom. One asked "Where is a sniper when you need one?"
That's just plain sick. And they think we are? I'd tell them to go to Hell, but they're already there.

Dave, I asked this before but not sure you saw it or if you did I did not see your reply.
When Casey is convicted will the jury then deliberate on Life and Death or does the judge decide like they do in Texas? If the jury does decide and comes back with LWOP can Judge Perry go against them and give her the DP?
In Florida, Peggy, the jury must be unanimous in the guilt phase, whether guilty or not. If Casey is convicted, it goes to the penalty phase and only a majority rule is necessary. That means the jury, by a vote of just 7-5, would recommend LWOP or death. The key word is recommend, because the final decision rests with the judge. Generally, judges oblige juries, but not always. Judge Perry is 8 for 8 in the DP department, however, I have not researched the jury's decisions in any of those cases or whether Judge Perry overruled their recommendations.
I was watching IS this morning and they had an ad on for an upcoming story about Casey, what she did in those 31 day. It is suppose to be on in May. Not sure why they would do this just before the trial starts, but then a book has already been published about it so I guess, why not.

I'm hoping this finds both you and your computer in full health!
Do you think there is any way that the State can put a stop to the airing of the 48 Hours program? I am going to have to be restrained when I watch; I wanted to break my television just learning about it!
And, have you ever considered taping yourself and uploading your commentaries to youtube? Just a thought.
I'm hoping that the post-April 18th announcement will be that In Session has hired you to guide their coverage!

I'm on the mend, PKR, and I'm happy about that. My computer is working, too. It was the browser.
The State cannot stop media from publicizing whatever it wants. It's that freedom of speech thing that gets in the way. Even a judge's gag order wouldn't be able to stop it. That only keeps people involved in the case from talking, like the lawyers.
To be honest, I've never thought about taping any of my comments, but to be honest, I prefer reading over listening. If anything, I'll do bedtime stories. I will tell you up front that it's not InSession I will be working for. It is a writing gig.

PKR, the way CBS's 48 hrs goes they give a big hype scenario for the preview and the show rarely lives up to the hype. I'll watch out of curiosity, but I have a feeling after that monumental scene we see in the previews, they'll then ask them "who would convict for second degree murder" and some will stand then if not all. This is all part and parcel of what we get before each sensational murder trial. Remember Scott Peterson... same thing. He still got convicted mainly because he got tripped up by all his lies, which will happen with Casey. The one bit of circumstantial evidence they have that hasn't even been addressed by the defense is why all the lies for 31 days? The more they talk the deeper that hole gets.
Had to smile about your remark about Dave being a guide to In Session's coverage. He can be our "man on the street", the "non-legal expert" or give the "blogger's take" on the case. Great idea!
I was reading a few of the comments about the DP or LWOP. I was on the fence. I was swayed more to LWOP, but seeing Casey's actions thus far in the pretrial hearings, I am now back to the DP. One question keeps nagging at me. Why is Casey's life more important than Caylees that she should get LWOP instead of the DP? So far, all I can see is a "spiteful bitch" which Casey even admitted to being. And I think that's it in a nutshell. She's just mean, spoiled and vengeful. Is that a crime? No, not until you kill someone. But, if she gets LWOP justice will have been served.
Dave, you take care. My husband is a diabetic. We know what it's like. Getting the meds right is half the battle. I can't wait to read your next entry but not at the expense of your health. No worries. I'll just plug in the IV drip of valium and wait patiently :)
I'll tell you, there's nothing fun about diabetes and you're right, the medication part is only half of what the didease is all about. Thanks, I hope your husband is doing okay.
I just sent a complaint letter to CBS objecting to the airing of this 48 Hours show on Saturday , April 16...No matter what I feel, I do believe that Casey is entitled to a fair trial and Caylee can only have her justice with an impartial jury...I will live with the verdict and I'm sure Judge Perry will see that the trial is fair and just....

Hi, Dave. Sorry to hear you have been feeling less than wonderful & I'm also sorry I missed the show on Sunday.
I have not read back in your archives, but perhaps you could re-run a few of your early blog entries when there is not "breaking" news. You need to rest up and get yourself as healthy as possible before the trial starts. I'd be interested in reading how they compare to what we [okay, you] know now.
Seriously, dude, you need to take care of Dave before you can worry about taking care of justice.

I was thinking about re-running some of my older blogs, but there's still lots of new stuff to write about. I may do that, too, because it's not a bad thought.
