Good grief.... let us know what you can find out, Dave. OMG, if there is another delay, I may take up knitting. The media attorney struck me as a person who would take this to the higher ups if necessary. . We will check in for any updates. Thanks Dave!

I do not see any of the bigger news outlets filing an appeal such as WESH, WFTV etc. I am waiting to read the documents or do we get to see them as per usual? I know you are busy but I will check in later. In the meantime, if I find anything, I shall fly back with it....toodle...eee ....doo

I am not surprised that an appeal has been filed also not sure the woman was representing the defense or both defense and the Media. I was disappointed in the manner of Judge Perry toward her. Not his decision and why he made the decision. He gave her slack here and there while toying with humiliating her. It seemed unprofessional that he enjoyed putting her down the way he did. Somewhat smart ass, definately portraying himself as the tv (media) Judge Joe Brown personality. imo she tried to present her case according to the laws and judge made it to be about her lace of personal experiences.

From where I was sitting, she raised her voice on several occasions, New Puppy, and I thought she was giving him a hard time. That caused him to become somewhat animated.

    lack of.

New Puppy~~I noticed that Judge Perry was very short with her, especially when he slapped down all those papers and said, "just look what I had to read" not verbatim. He more or less said that is why he did not have time to rule on that latest motion. I honestly can't blame him in one respect as he does have a lot on his plate. It was a heated exchange for sure. If this trial is delayed, the new outlets who are making this appeal may watch their ratings decline. Is the defense behind this latest ploy to create a delay? I wouldn't put it past Cheney Mason but I do not think Baez would be brilliant enough to do something like this.

Some news outlets should not bite the hands that have been feeding them or take people for granted.

    May 3, 2011 | Registered CommenterSnoopySleuth

This upsets me that they would file this. I thought the attorney that filed this motion was unprepared and she was a little arrogant towards JP. I don't blame JP for being the way he was. He is trying to get this trial going and doesn't want a mistrial or her to not have a fair trial. I don't understand why the media can't wait until the day of to make the announcement of what county it is in. They are going to tick a lot of people off if this gets delayed.

    May 3, 2011 | Registered CommenterMary Jo

To tell you the truth I wasn't really aware that this motion was the whole raison d'etre of this last hearing so to me it all came out of left field. I think to him what he's requested the Media to do is perfectly reasonable given possible outcomes and that this was just entirely unnecessary on their parts. He was short w/her but, you know, she was only about as prepared in her arguments as Jose usually is.

Very sad day. I personally am ready for this trial to start, not that anyone cares about me but this is not healthy. Everyone needs closure. George and Cindy need to be able to move forward. They can't because they are to busy lying for Casey. The media is pushing this way to far. Why the need to go and interview people? Why not wait until after jury selection? Frustrating. Need to scream, but can't. Would scare the he!! out of the people sleeping in the house.

    May 3, 2011 | Registered CommenterLaurali

Yes he was short with her. But good grief where did she think she was at? She kept talking over JP, very rude lady.

    May 3, 2011 | Registered CommenterLaurali

Laura, go outside and scream then you won't wake them up inside, but you will probably wake your neighbors. LOL. Put a pillow up by your face and scream into the pillow. I feel like screaming too. This really makes me mad. They should be concerned that a 2 yo little girl that was murdered that needs to get justice.

    May 3, 2011 | Registered CommenterMary Jo

Mary Jo~ Don't want to wake the neighbors. :)

Dave how long could it take for the appeals court to hear it? Can they get to it tomorrow? Thursday? Curious minds need to know!

I have no idea, Laurali. I haven't seen the motion yet. Soon, I hope.

    May 3, 2011 | Registered CommenterLaurali

I certainly hope there's no delay. I hope they don't have to do the "I've filed the complaint, you have to file the answer then wait for a court date" on this one... hope the appellate judge looks at it and denies it out of hand on grounds that it's baseless. JP said the information could only not come from the judicial side.. I don't see a problem with that written as is. So I'm going for small to no delay.

I felt the media outlets should have hired a more experienced lawyer to handle this case as this one didn't seem to come completely prepared to argue the case. A more experienced one could have answered Judge Perry's questions and stood up to him better. I can understand his frustration because he's trying to get this case to court and over with once and for all and people keep throwing stuff at him. I think everyone involved in this case can hurry it along with just 2 words to the media "no comment" instead of giving interviews to InSession, etc.. The one thing no one wants to hear except maybe Casey are the words "to be continued".

I think the defense might be in on this for a delay. We have known these media rulings for quite some time yet they wait to the last minute to bring this up.

The media att'y was so out of her league. As with Baez, JP begged her for case law & to articulate WHY having the media sign an agreement to not disclose until after jury selection starts is detrimental to public records law. She had one foot out the door & you could tell she was headed to appeals court. JP was clear how this case would play out if his decision is reversed. JP explained his reasons & defied this att'y to go to the 5th circuit ct of appeals. I do not think he will be overturned. Every decision he has made is on point according to the law. I believe JP made a "test run" in palm beach in preperation for this hearing & his decision & possible appeal. JP will make sure it is a fair trial.

Why in the world is the media biting off its own nose to spite its face? If the trial has to be delayed six months or more because of this bizarre insistence that they be advised where the jury will be empaneled (just a handful of days from now!), how will that that increase their ratings or improve their bottom line? If anything, I think it will dampen interest in the case because all of the motions have been filed, and the Anthony's have finally clammed up. Less public interest = less dollars in their pockets.

As a side note, I cheered JP's righteous zeal regarding Casey's right to a fair trial. It was terrific.

Here is the latest from the Sentinel. I guess the appeal is now being reviewed by the 5th District Court of Appeal and they are 'aware of the time-sensitive nature'.

Casey Anthony trial: Three appeal judges review media’s petition for jury selection notification
Sub Heading: Several media outlets appealed Judge Belvin Perry’s ruling, which could delay the start of the Casey Anthony trial.

Three Florida appeal judges are reviewing a petition filed by several media outlets who oppose Chief Judge Belvin Perry's order related to the public notification of where Casey Anthony's jury will come from.

[Joanne] Simmons [spokeswoman for Florida’s 5th District Court of Appeal] said the judges are reviewing the petition and there has been no request for oral arguments.

The judges are aware of the time-sensitive nature of the appeal, but cannot predict when a decision will be made...snipped

I agree. I feel Judge Perry really sighted just cause right there at the hearing for what he was doing. I also think it is a powerful statement in concurrence with the judge, that all the local media have dropped out.

Here is a link from WFTV on Baez's latest attempt to taint the jury pool. Apparently, he was taking questions from the media, not giving an interview to WDBO radio.

Hey Dave, this does make for a can of worms that Judge Perry has to open up. I do not envy him at all. I was not impressed by the attorney for the news media. She was very unprepared and I do not blame Judge Perry for being short with her. But now we are waiting for the three judges to decide what will happen next. This is a big pot of crap. The news media does not need to know where the jury is coming from but they do need to report on the trial when it starts. I hope they deny the requisite so this trial will start as planned. It has been almost three years, it is time for Justice for Caylee.

When that attorney first stepped up to the podium I thought it was Rosie O'Donnell. I think Rosie would have been better prepared.

In the end, Peggy, I'm sure the Fifth DCA will rule in favor of JP. Not only is he well known and highly respected among his peers, there's nothing illegal about his ruling. I'm not going to worry about it.

“We could have to wait an extra 48 hours to find out when the trial will start,” WFTV-Channel 9 anchor Bob Opsahl said tonight.

Retired Circuit Judge O.H. Eaton Jr., the legal analyst for WESH, didn’t see likely success for the media companies. “The petition has to show that Judge Perry has not followed the law, and secondly, they have to show there’s irreparable harm as a result of it,” Eaton told Bob Kealing. “That’s a pretty high mountain to climb, and these petitions are generally denied.”

In another report, WFTV’s Jeff Deal explained that two protest zones will be set up...snipped

WKMG-Channel 6’s Mike DeForest explained that at 7:30 each morning the first people will get a pass to go inside the courtroom.

Central Florida News 13’s Jacqueline Fell surveyed a “free speech zone” outside the courthouse.

Here is the order from the 5th Disctrict Court of Appeals. It's short and to the point.

    Thanks again, Snoopy!

Orlando Sentinel: Restricting news coverage in the Casey Anthony trial sets a dangerous precedent
    Quote:
But Perry has done something else that he acknowledges is unprecedented. We think it's also unwise, and unjustified.

Both the U.S. and Florida constitutions enshrine the principle of a press free from government restriction.

Perry's agreement, no matter how limited, would erode this constitutional bedrock by giving the judge new control over access to an open proceeding in his courtroom.

If it is accepted as an excuse in this case, it could be cited to choke off more public information in future high-profile cases.

We have complimented Perry for his steady hand in presiding over the Anthony case. But like any judge, he is not infallible. He should reconsider, then rescind, his restrictions.
    End of quote.

The Defense’s Pro-Bono Jury Consultant, Richard Gabriel: (At about 2:06 minutes in.)
I don’t think it’s detrimental to either. Quite frankly, I think that a delay would be a good thing for a couple of other reasons. One is, I think, because of the wide spread publicity, we would like to go into whatever venue we’re supposed to go to; and really understand exactly how that venue has been effected by the publicity. We don’t know where we’re going right now so we really can’t study it. Although Orlando is certainly has been inundated with a majority of the publicity; quite frankly, the whole state has been saturated with this; and we should be able to go into wherever we’re going to be located, to find out really how people have been effected by this publicity. So, I think the delay actually would be a good thing—for both sides—and an opportunity for the judge, the prosecution, and the defense to really conduct this jury selection in a meaningful way.

This whole case is like manna from heaven for any print outlet down there, in an environment such as this and an industry that's slowly going extinct. I might just invest in a few billable hours with a top attorney too, just on the off-chance- tens of thousands if not hundreds of thousands potentially involved the longer this can be dragged on....

They have to get this in the record (new venue). They'd object automatically to ANY venue chosen.
