    That Smell

    On June 27, 2008, Casey Anthony contacted her close friend, Amy Huizenga, about a peculiar odor emanating from her car. The message was clear, and it was confirmed during Amy’s deposition taken on February 14 of this year. Jose Baez asked her about it starting on page 32:

    Q: Okay. Now, she sent you a text message in reference to the smell of the car; is that correct?

    A: Yes.

    Q: Okay. And that was on what date, do you recall?

    A: I think it’s in here somewhere. I don’t know what day it was.

    Q: I can help you if you want to look towards the date for your statement to confirm it.

    A. That would be great.

    Q: Okay. The 27th. June 27th.

    As the interview progressed…

    A: Okay. Yeah, the 27th is when she confirmed - - like, when she said it was. But there were definitely a day or two that she had been like, dude, my car smells and I don’t know what it is. Just, like, one of those - - I mean, I think everyone’s had the time you’re like what is that smell. I don’t understand. And she just said it smelled, like, you know, something had died in her car and she had no clue what it is. And I think it was - - she - - it was coming from the engine areaish is what she had said. And then when she - - you know, finally, it was - - she was letting me know she had found it was and that was a squirrel that she figured her dad had run over when he was driving the car.

    Q: Let me ask you this - -

    A: Yes.

    Q: - - do you have any other text messages about the smell or was it just that one text message?

    A: I don’t know. You have the text messages.

    What’s so important about this exchange is the fact that Casey acknowledged the odor of death in her car, as confirmed by a text message written and sent by her. She also told Amy that the smell had been in the car for at least one day, perhaps two. Was this the start of attempting to pass the blame on to her father?

    Q: Okay. Do you know if you spoke about it before the 27th or after the 27th?

    A: Before, because the 27th was when she said what it was and there was at least a day, if not two days, that she told me about the smell.

    We have now established that Casey freely admitted that the smell of death did, in fact, exist in her vehicle. This leaves us with two possible choices: Casey knew exactly what it was and she was working on an excuse to cover it up, or she had no idea what caused the foul odor.

    Let’s fast forward a bit to Amy’s conversation with Cindy, after Cindy picked her up at the Florida Mall. Remember, Cindy called 911 that night and uttered those now famous words,  “I found my daughter’s car today and it smells like there’s been a dead body in the damn car.”

    Within a week, she changed her tune. “It smelled like something had died in the car. I smelled it. I thought something had died in the car. I didn’t know what it was. It could have been a squirrel. It could have been anything. But when we opened the trunk and we saw the maggots in the trunk with all the pizza and stuff, it was a rancid smell.” (See: http://www.wftv.com/news/16981004/detail.html)

    She also told FOX News, “Do me a favor, put a little piece of pizza or any piece of garbage in your car today and leave it shut up for 15, 16, 17, 18, 19 days in this heat and then come back to me in 19 days and tell me what it smells like.” (See: http://www.foxnews.com/story/0,2933,389642,00.html)

    What she did was a complete spin. It meant that the smell of death was not really death at all, it was pizza and other garbage found in the trunk that reeked so badly. She told the 911 dispatcher about the smell of death for one reason only: to quickly bring law enforcement to the house. She didn’t really mean what she said. Excuse me. Never mind. Except for one major issue. It wasn’t only the dispatcher she told that to.

    Starting from page 52 of the deposition, where Amy dropped Casey off at Anthony Lazzaro’s apartment in Winter Park…

    Q: Okay. And then where did you go?

    A: I went to the Florida Mall with JP [Chatt] in his car because he wanted to go pick up the new iPhone that had come out while we were gone. And the Florida Mall is fun to walk around in so I tagged along.

    Q: Tell me about the conversation when Cindy calls you. What happened - -

    A: She called me and asked me - - you know, obviously stated who she was and then asked me if I had seen Casey or Caylee. I was, like, well, I just saw Casey like an hour and a half ago, but I haven’t seen Casey - - or Caylee in a while. And so she proceeded to tell me that, like, she needed to find her, that she was going to be in really big trouble. I believe she mentioned jail for some reason. I don’t recll what the reasoning was why she was going to be going to jail, but just seemed very important that she find her and that she hadn’t seen her in a long time. So that the car - - her car had been impounded for two weeks and that she just really needed to find Casey.

    Q: Did she say anything about the smell in the car?

    A: I don’t think she said anything about the smell of the car on the phone conversation. She said - - she did later in the car, but not, I don’t believe, over the phone.

    AHA! I received an e-mail yesterday afternoon. A very nice person, who shall remain anonymous, wrote this to me:

    I read the deposition of Amy. In it, Cindy states to her that the car smelled like a dead body had been in it. She says the same thing on the 911 call later. Then much later she says that she would have said anything to get the police there ASAP. I think saying that to Amy BEFORE the Police might come back to really haunt her.

    She makes a very valid point. Continuing with Amy’s depostion:

    Q: Okay. So then [Cindy] picks you up at the Florida mall?

    A: Yes.

    Q: You got in the car and then what’s the conversation like as you’re going to Tony’s house?

    A: Well, first it was a, it’s nice to finally meet you because I had yet to meet her at that point. And she told me - - like actually then told me then the whole story of the car impound, that was when she told me about the smell.

    Q: What did she say in describing the smell?

    A: She said that it smelled - - it was the most horrible smell that she had ever smelled and that they were terrified that it was either Casey or Caylee in the car - - in the trunk until they got it open. But that was - - that her fear and she was barely controlling, like, emotion in saying that. Like, it was - - you could see that that was still something [t]hat she remembered being upset about that that thought was in her mind.

    Q: Did she say she smelled the car or did she say George smelled the car?

    A: Both of them. I believe they were boh there.

    Q: Okay. So she’s telling you this on the way to Tony’s house?

    A: Yes.

    If it wasn’t the odor of death, what prompted George and Cindy to immediately think of Casey and Caylee’s well-being? Here are two snippets quoting George and Cindy’s own words from a transcript of the HLN program, Nancy Grace, dated November 17, 2008:

    GEORGE ANTHONY: You guys don’t know! The person who was in the back of my granddaughter’s (SIC) car is not my granddaughter!

    CINDY ANTHONY, GRANDMOTHER OF MISSING TODDLER: My husband is a deputy sheriff. Years ago, he was a homicide investigator, as well. And the first thing he thought was human decomposition. I’m a nurse. I thought human decomposition.

    It’s interesting, to say the least. Ooooh that smell!

    This is a good example of no matter how worried we are about what could be bad is to learn to keep our mouth shut but fearful emotions take over and out it comes, sometimes not to our benefit.

    When reading Amy's deposition I saw she said that, but I didn't connect it like the person that wrote the email to you did. It does make it very interesting though. I am glad that person sent you that email. Cindy obviously doesn't remember what she said to Amy, but I believe she deliberately lied when she said she would say whatever she could to get them there. If that was the case, she would have told them on the first call. I can't wait until this part is brought up in the trial. Thanks for letting us know about this and thanks again to the person who sent you the email.

    Dave, good write up and easy to understand if hearing it for the first time. The defense filed a motion trying to say that Cindy's, "it smelled like a dead body was in the damn car," was an 'excited utterance. Motion denied.

    Besides the canine noses but yet to know the ruling on that by Judge Perry, we have some good human noses. Who better than Yuri Melich, a well seasoned homicide detective who was working in Missing Persons. Yuri testified at the bond hearing that he smelled the smell of decomposition coming from the trunk of the Pontiac Sunfire. Johnson's Towing owner's nose, he was familar with the smell of decomp after finding the remains of a man who had been in one of his towed vehicles for around five days. George Anthony, ex homicide detective's nose and Cindy Anthony, ex orthopedic nurse's nose.
    Let's not forget Dr Vass who should be able to testify and give his opinon even if his air evidence is not allowed in, Dr Vass opened the can containing the piece of carpet. His words, "the smell knocked me back a couple of feet, the odor of the decomp was that strong"

    How can the defense explain away all of the above?

    I call my 7 kids by the wrong names all the time..am even worse about the 5 granddaughters! But, I have yet to call my daughter my granddaughter, and can't imagine mixing the two when talking about a 2yr old.

    Re the smell..the truth is almost always said without forethought or planning. It just comes out. Later comments are made trying to "fix" the problem the truth has brought to light. Lies, in other words. The prosecution should have no trouble, I hope..

    I think most of us here would agree that George and Cindy both knew when they smelled that car exactly what that odor was. It was when Casey was arrested and they realized that she was responsible for Caylee's disappearance that they went into overdrive to once again protect Casey from her bad deeds. It was an ongoing practice of theirs to do just that.I truly believe that is what has made Casey what she is today. Never having to be responsible for anything.

    Cindy is talking to Amy about seeing Casey and Caylee, I thought Cindy had talked to Casey on the phone before but maybe it was that Cindy had been trying to reach Casey and left messages. Boy the jury is going to have a lot to sort out in their heads. Just getting one date wrong or one statement in the wrong timing messes with my conscience in accuracy. Maybe this is the only way the defense thinks they have a shot is mass "confusion" until the jurors can't honestly make a conscience decision

    I do not believe at the time Casey mentioned her dad may have run over a squirrel she meant to claim anything on her dad at that time. Later, it may work if they "all" including George, use it, He could agree that he did run over a squirrel. Then there is the question, did George drive Casey's car before Casey made that comment.

    Huzenga's Depo, clearly points out that she never saw Casey be mean to Caylee or be a bad mother to her. She does however, start to mistrust her ramblings about living together at the Anthony home,, so much so, she wanted to drive to Casey's house to see if there were all these workers there, as she told Amy, regarding the house being unavailable to move into. The fact that Cindy denied to Amy, that she and George were considering divorce, moving out of the house for Casey to move into it. I think it will difficult to intimidate Amy on the stand, because her deposition is pretty clear cut. There is no reason for her to change her opinion or mind about what happened those days from 30th onward. Looking back, Amy was surprised that Casey stayed on her couch and didn't go home. Well I would say that's because Caylee was dead and she didn't want any questions from Mommy Dearest, the one person she admits, she didn't get along with. It's going to be difficult for Baez to get get Amy to agree that George would have hurt Casey in any way, causing her to loose control, or even more importantly, George loosing control. This is a fabrication and we can clearly see through Amy that things were falling apart in late June early July.

    THE SMELL OF TRUTH, not death is what we clearly are looking for, but I'm fearful there is no SCENT close to that, not so far anyway.

    Was Casey's car towed from Amscot on the 27th or the 30th? I think it sat there for three days before it was towed, so when Casey was sending Amy those texts she might have abandoned the car already. There is no way that George had access to that car during those 31 days.

    New Puppy, I am not sure when George would have had the opportunity to drive Casey's car. George testified that he watched Casey and Caylee leave on June 16th. The next time he saw Casey is when she came home on June 24th to get a change of clothes. George had his vehicle parked inside of the garage and Casey was surprised to see him home. That is the day that George asked to get into the trunk to get the wedges to rotate the tires on Cindy's car. It was the same day that Casey rushed by him and practically threw the gas cans at him. It was not until July 15th that George drove the Pontiac Sunfire home from the tow yard. Unless George was lying, he never had possession of that car.

    Mary Jo, Casey's car was abandoned at Amscot on June 27th, the day Tony picked her up there after she called him that she had run out of gas. The vehicle was towed away from Amscot on June 30th. by Johnson's Towing.

    Liar,liar. pants on fire!

    Judge Judy often says "If you tell the truth you don't have to have such a good memory."

    My dearly deaparted Mother In Law had an old saying "So and So would rather climb a tree backwards to get to tell a lie rather than stand on the ground and tell the truth."

    I don't think anyone in this family knows how to tell the truth. Which one of the said "A dead squirrel climbed up in the car?" Hmmmm..didn't know dead squirrels could do that.

    Now on the serious side I wonder what is taking Judge Perry so long to rule on the rest of the motions.

    In a statement by Debbie Polisano, Cindy's supervisor at work, Debbie tells about when Cindy goes back to work after picking up the car from the impound lot. Debbie says Cindy told them the car still had the baby's car seat and her doll. Then she remarked on the terrible terrible smell. Debbie says they questioned who/ why anyone would leave a car seat and doll- immediately alarmed. Debbie asks if George and Cindy opened the trunk and Cindy didn't answer. Debbie tells Cindy to go home immediately and call the police. Cindy didn't leave so Debbie got another boss to tell Cindy to go home.

    Why George and Cindy didn't call LE at the tow yard when they discovered that smell? I think that's when the A's cover-up started.

    Cindy "just wanted to give Casey a chance to explain". I'll bet she did.

    Cindy immediately went into high gear with another casey clean up campaign but this time; destroying evidence. You'll never convince me that George and Cindy didn't know that was their grand-daughters decomp smell coming from the trunk.

    Thanks for clearing up the fact that Cindy DID tell Amy about the smell in Casey's car on the ride to Anthony Lazzaro's Dave.

    The judge in the Casey Anthony case issued several key orders Tuesday afternoon about evidence prosecutors want to use against her in next month's first-degree murder trial, mostly ruling in favor of the state.

    Orange-Osceola Chief Judge Belvin Perry ruled that evidence of heart-shaped residue spotted on duct-tape that covered 2-year-old Caylee Marie Anthony's mouth could be admissible at trial, so long as the state lays the proper foundation as is required of all evidence.

    That piece of evidence is significant because investigators also found heart-shaped stickers at the home Anthony and Caylee shared with their family.

    Perry also denied a defense motion to exclude expert testimony about "post mortem banding" on a single strand of hair found in Anthony's car.

    The judge said that Karen Korsberg Lowe, a hair and fiber examiner at the FBI Laboratory in Quantico, Va., testified that "it is generally accepted in the field of forensic hair examination that such root banding is characteristic of a hair that has been on a decomposing body, although it is not known why this banding occurs."

    Perry noted that Lowe included the phrase "apparent decomposition" in her report, signifying "that's not the only possible scenario this hair came from a dead body." She also said that of all the hairs examined for this case, only one showed "post-mortem root banding."

    "Ms. Lowe's testimony will assist the jury in understanding the testimony about hair found in the trunk of the defendant's car, it is based on a scientific principle that has gained acceptance in the particular field to which it belongs, and Ms. Lowe is a qualified expert," Perry wrote in this order.

    The hair evidence will be admitted as long as the prosecution establishes the proper predicate.

    "The jury will be entitled to determine the credibility of her opinion, which it may accept or reject," Perry wrote.

    Perry also ruled that evidence and testimony about cadaver dogs used in the case is also admissible at trial, so long as prosecutors lay the legal foundation.

    Thank you to those that answered my question as it sat in moderation. I understand Dave has many irons in the fire right now and appreciate the help you are giving him.

    Judge Perry has to rank at the top of the list in knowledegable and fair judges. He backs up his rulings so that even I can understand most of it.

    Starting to look a little like little Caylee may just get justice after all..

    B...b...but! Cindy is a nurse of decomp so she knows that the smell was not the smell of death!

    As it has been said before, just telling LE that there is a missing toddler is enough to get LE's attention and aid pronto. Cindy is so transparently backtracking but she can't give a plausible excuse for why she said what she said to Amy and her co-worker. Cindy's words are like feathers coming out of a slit pillow-they fly everywhere and most are irretreivable.

    Cindy and George plus the tow truck man all knew what had been in that car. I think any one of us would have known if we had smelled it with no previous experience. I live out from town and every once in a while you can smell a dead animal in the woods. You know what it is without even seeing it. I am so glad the cadaver dogs were also let in. With all of this there will be no doubt a dead person was in the car and that person was little Caylee.

    Here is something more important that her Mission.... Bill Sheaffer now thinks that Dr Vass' air samples may be admitted because Judge Perry allowed the post mortem hair banding in .

    Ahhhh, I just wanted to do a little armchair lawyering here .... please don't laugh too hard.

    My take on the Motion filed by Mr Lippman on behalf of George and Cindy Anthony to be in the Courtroom.

    George and Cindy Anthony have displayed through their emotional outbursts, body language and changing their testimonies that they are supporting the defendant and not the victim in this case. While George and Cindy Anthony are the next of kin to both the victim and defendant , their presense in the courtroom during the trial will be prejudicial to the state while trying this case. A person's body language can be witnessed by the jury, even though that person is in the audience and not on the witness stand. For instance, if a witness is on the stand testifying and states something George Anthony does not agree with, he may shake his head or display disgust. George has emoted this exact behavior at hearings held in this case.

    I suggest that Judge Perry Decline the Motion and not allow George and Cindy Anthony to be in attendance in the courtroom until, at the very least, after they are finished their testimony and are excused from the court.

    LOL... I just wrote a motion for the state rebutting Lippman's motion.

    Great post Dave and thank you to the person that sent you the email on what/when Cindy mentioned to Amy about the "smell of death" in Casey's car that she and George smelled. I am so anxious for this trail to start.

    Will the state call Cindy as their first witness since this all started with her 911 phone call? It will be interesting when Amy gets on the stand and contradicts her testimony if it indeed does. Surely Cindy will not continue to lie on the stand. I know it has been said that Cindy and George will not be prosecuted but I still think that because they lied to law enforcement they should be charged with Obstruction of Justice. Oh well, I am sure everyone thinks they have been through enough and when Casey is convicted and put on Death Row their job is done. With the new rulings of Judge Perry I do not think is not be a slam dunk but it is getting better and better. I am looking forward to the chloroform ruling, I believe it will also be included.

    I am glad that you are felling better, at least I hope you are Dave. I am so looking forward to your new job with the OM, you are going to do an amazing job.

    While I do not believe that charges of obstructing justice will ever be brought against George and Cindy, they will leave themselves wide open for perjury charges if they deliberately lie on the witness stand during the trial.

    Of course not Snoopy, thanks for replying. I am anxious to get this thing going, I want to see how George acts on the stand, he tends to make statements he should not and he is going to have to answer all the questions even if he starts to cry. This is going to be tough on him but it is what it is. I would bet good money that Cindy does lie, she can't seem to help herself. The apple does not fall far from the tree when it comes to Cindy and Casey.

    Snoopy do you know if Dave will be reporting on Jury selection or will he wait until the trial starts?

    Katydid~ You have no idea! I cannot even read there.

    Terri~ I believe you said it best. Casey is a child that need not worry about her actions. Mommy and Daddy will cover it up. Not anymore! I absolutely think they did more harm than good while raising Casey. It is never okay to let a child lie. It is never okay to let a child steal from parents, sibling and grandparents because then they think they can steal freely with no punishment.

    I am glad JP has let all this evidence comes in. The State is building a case, every piece of evidence will convict Casey. I am convinced she murdered her daughter and I am convinced of that because what we know so far. Jose has nothing and no one to blame this on but his client. It is so obvious, that is why he needs all this evidence thrown out. He should have taken that first 200,+ and bought Casey a defense. You know actually call a real lawyer and get advice on how to defend a murderer.

    Peggy222~~I believe Dave will be writing an article referencing many things about the jury, selection, things the defense and/or state will look for when picking a juror... would you believe that they go to this secret county to start jury selection in less than 2 weeks... Judge Perry is going to tell the state and defense which county he chose for jury selection, next Monday, May 2nd.

    I remember when this case was just getting started, LE was questioning George.....I remember George saying " Nothing else smells like human decomposirion. It's something you never forget . (Not verbatim, but close ) So if I leave some leftover pizza in my car and maybe a few pieces of other garbage.....maybe throw in a little dog poo, leave it there for a few weeks it would turn into human decomp? I guess you can't blame them in their position....throw whatever you can at the wall and see what sticks.

    Pizza and dog poo poo tends to dry out in the heat rather than rot to the point it would attract blow flies and maggots. Decomposition could be classed as a signature odor and like a fingerprint , there is no other odor that can match it, animal, vegetable or mineral.

    Laura, I do not think there is a attorney that could not only win this case but actually be Casey's attorney. You would have to be nuts to even get close to this case. I would bet you good money that Mr. Mason is not having any more fun now. That comment he made really ticked me off, guess he is getting his just desserts now. But I think he got them when Judge Perry replaced Judge Strickland.

    Snoopy, it is hard to believe that they are finally going to trial. It will be interesting to see just where Judge Perry is going to find this jury. I look forward to Dave's posts on OM about the jury. I still say that they will give her the DP. I know you do not, but have you changed your mind now with all these rulings?

    prettyinpinkxo~~the grieving process takes around two years. You never forget your loved one but time helps a person to cope. The Anthony cannot use the excuse that they are grieving. They looked quite relaxed and happy while on their cruise getting their tattoos.

    You cannot use the excuse that you are grieving to lie in a court of law. Granted, they don't want to see their daughter face the lethal injection but they have to face the reality that , if you do the crime, you must do the time. Why should Casey be spared from having to pay for a crime, if she committed it? Casey is not a celebrity and the Anthony's are not the First Family. A child was murdered and laws were enacted to see that victim gets justice. Legislators are voted in to change the laws, not the Anthonys.

    Peggy222~~no, I have not changed my mind. I honestly don't believe, even with all the evidence, that Casey will get the lethal injecttion. There are a few factors that weigh in for a jury not to give her death in the penalty phase. I am not basing my opinion on my own beliefs about the DP. If there was a video that showed Casey, in a state of rage, murdering Caylee in a heinous manner, yes, I can see her getting the DP. The only other would be an eye witness to the crime and there is neither. Of course, I could be wrong and remain open to everyone's thoughts.

    One last thought- I believe the DP remains on the table to help insure that the state will get LWOP for Casey. It that happens, they will have won.

    Prettyinpinkxo, I too think we'll have our jaws dropping when the A's get on the witness stand.

    Cindy "absoulutely" can't answer with a simple yes or no, she has to skirt around and embellish every question while qualifying herself as traumatized. I wonder if she ever thinks about her beautiful little grand-daughter who must have been terrified the moment her little life was snuffed out? Maybe that's what she really means.

    Hopefully Lee will govern himself accordingly on his deal with the Prosecution to spill his guts with this whole charade.

    Thanks for the post Dave ,,To Beast that was not a typo George said What you guys dont know .The person that was in the back of my Grand Daughters car was not my Grand Daughter...I M O he made a Fruedian slip as in his mind he knows the car was Caylees tomb before she was dumped.Casey Dumped her Daughter an kept hold of the trash?

    Yes - I agree ecossie. George definitely made a Freudian slip on that one! Big time slip.

    On a different note - something has always puzzled me. If George is an ex-homicide detective and Cindy is a nurse, I have always wondered why they didn't just remove the trunk liner and toss it. It just slips out usually. Instead, they tried to scrub it down to rid it of the obvious stench and stain. Did i miss something?

    One last remark on the DP Snoopy, remember that Peterson in California received the DP and their were no witness, there was no video, there was nothing but his actions before he murdered his wife and baby and afterword. Sound just like Casey to me and there is a lot more evidence in Casey's case then there was in Peterson's.

    It is getting closer Casey, hope you and your "Dream Team" are ready. No more delays no more grandstanding because we are finally going to get Justice for Caylee.

    nymima~~decomp can penetrate right into metal. They probably took the liner out, scrubbed it, dried it in the sun and put it back thinking the decomp would be gone but no such luck.

    Ecossie's statement that Casey threw Caylee away but kept the trash is quite possibly the best line I have ever heard about this case. I hope that the State uses it it their opening statement. It truly does say it all about Casey.
