    Texas Equitable

    "My bus runneth over."

    I can almost picture a sign like that hanging on the wall of a particular attorney's office.

    Princeton University's WordNet describes equitable as fair to all parties as dictated by reason and conscience; "equitable treatment of all citizens". Three important words jump out at us - fair, reason, and conscience. I have come to believe that, during the course of two years, Casey Anthony's defense has been anything but that. A recurring theme continues to cling to the backs of our minds; who else will the defense throw under the bus?

    When Casey Anthony forced the hand of an extremely fair and equitable judge, that being the Honorable Stan Strickland, it was unconscionable. What we caught was a real life glimpse, a puzzling ponderance, into the stupefying notions of her defense and what they would be capable of doing to anything that stands in their way, past, present and future, if necessary. Trust me, I felt the wrath, but in the end, it was nothing personal because this team has no conscience. The age old idiom flares its nostrils and cries it's a dog eat dog world, only in real life, some people are mutts; wolves in fox's clothing. Yes, the first to fall, but not from grace, was the judge, who is regarded as one of Florida's finest. Next came Roy Kronk, whose alleged dalliances have nothing to do with this case. Why attack a man's integrity? Why would this defense foolishly infer that he was capable of murdering Caylee Anthony? When that idea fell through the cracks, the defense moved on. After all, the bottom line was that Roy had all the evidence he needed to prove he had nothing to do with the toddler's death. Of course, we cannot leave Richard and Jesse Grund behind. The heavy tire tracks are still indented in their reputations, unscathed prior to this debacle. They haven't had a chance to scrape themselves up from the defense road to virtual perdition.

    Now, we're faced with Tim Miller and Texas EquuSearch. A fierce and dedicated fighter who sought nothing more than closure and justice for Caylee's death, he, too, has come under the tread of Jose Baez's and J. Cheney Mason's tragic bus. Prior to Mason's entry into this case, the defense claimed that Casey was in jail when the body of the little girl was tossed away for vermin to devour. Therefore, she couldn't have done it. Dr. John Schultz, Professor of Anthropology at the University of Florida, concluded that the body had been placed in the woods off Suburban Drive before or soon after June 17th. Some of the evidence he examined to make this determination included the amount of decay on the bones, the scatter patterns of those bones from animal disturbances, leaf growth through the bags and the remains, and positive indications she was in those woods during heavy summer rains because of muck deposits on bones.

    Those are the facts. What the defense will try to prove is that there's no proof Casey placed the corpse there. They will also dispute the findings of Schultz and Dr. Jan Garavaglia, the Orange/Osceola Medical Examiner, who concurs. No one saw Casey do it, therefore, it could be anyone else, including a searcher.

    One thing that has captured my mind is this obsession with TES records. I understand it's the defense's responsibility to dig deep into all possible clues; to search for the, sometimes, elusive thread of hope, but I smell a set-up. The bus is rolling and looking for new victims; new lives to destroy in its path. Although gone, Todd Macaluso confidently declared a year ago that the body was placed there while Casey was incarcerated. Mason switched gears and said that no one entered the woods when TES searched the area in September of 2008. He acknowledged the area was flooded. This was a major revelation except for one thing – he didn't state that it couldn't have been anyone else who, in fact, did look on their own time and off the documented records kept by Tim Miller's group, almost 4,000 strong. It still begs the question, if no one from TES searched there in September, why the incessant need to examine all those records? Because the body could have been tossed in November or December by a TES straggler. Scrutiny is the key element.

    The tack this defense is taking is not unusual. It will rely on discrediting the state's evidence, which is predominantly circumstantial. Call it mucking. All the defense has to do is debunk whatever it can, and never mount a credible attack based on their client's innocence. That's why they never looked for Zenaida Gonzalez. She doesn't exist and never did. Why seek what isn't there? Casey will never take the stand and she will never seek a plea. Why should she?

    In my opinion, Baez & Company will scour over those records. Openly, Baez said, “We just want to be as thorough as we possibly can.” Behind closed doors, it may be another matter. When Chief Judge Belvin Perry granted the defense full access to those records with the stipulation that they not be allowed to publicize any private information about the searchers, it was a victory of sorts. Why? Because 4,000 people will have their cans of worms opened and the skeletons in their closets will be scrutinized beyond reproach.

    What will stop this team from stretching out their arms and pointing fingers at several searchers as possible suspects fully capable of murder? Why couldn't it have been someone else, a real “Zenaida” who stole the girl and joined the search in order to hide her? Holy mackerel! The mother lode! If a Zenaida Gonzalez exists, it will be one from TES. Under an assumed name, of course.

    In the final quarter of 2008, I was not healthy enough to help search for the missing toddler. Today, I'm almost glad, because I would now be one of the many names the defense team could target. Oh well, they're going to be going after people with criminal records and disgruntled ex-spouses. In my case, it's immaterial. In life, I try to be fair. I know how to reason, and I have a conscience. Just like Tim Miller and all those searchers, who only wanted to help. From the defense, all I'm smelling are exhaust fumes because my bus already came and went. Tim's is on its way. That's not very equitable, is it?

    And I didn't know about that craigslist posting. That is terrible and I see it happening all over again. Just like Dave said in his article.

I just pray that Biaz does not muck it up and then they have a mistrial. I wonder if that is what he is going for? He is way out of his league on this case.

    I don't know Peggy222. This case is starting to really worry me. I guess maybe it's because we only hear from the Defense side. Which is mind blowing to say the least. I would give anything to know what the STATE really has. If they do have direct evidence.

    Shyloh, I think the evidence they do have is what will put Casey on either LWPP or on Death Row. The 31 days w/o calling LE, the decomp in her car, partying all the time in that 31 days, lie after lie after lie to everyone. I am not worried that the State does not have enough evidence. I think they have what they need. I will be glad when May gets here, lets get this trial started.

    Freat article Dave! I wonder if the defense or The Anthonys still ever read here? If so, I wonder by this eloquent post if it would make them think, and "have some sonceience" Or if they never will have sleepiness nights wondering what they have done and how wrong it is, especially The Anthony Family. We can only hope their true conscience would, but maybe it really never ever will...sadly. I just wish for the loved of their beloved Caylee that they would.

    Dammit Dave I hope you do write a book..and soon. You are going to be criticized and possibly castrated when you do for making money off 'our' Caylee. Should you write the book before trial, during or after. That's the question. WHEN.
    How this catastrophe and circus has affected the 'average joe' on any given day and changed the way they feel about the involvement of the media, the attorneys and the internet bloggers would be a start. How well intended, kind and loving people, thought to be unselfish or selfless were driven to extremes or driven into the ground yet survived the unscrupulous. And maybe end it all with how groups of people unknown to one another came together because of a forgotten child and educated, learned and expressed friendship and love for one another in spite of their differences and opinions.
    Snoopy is so right on, and others, about the forensics in this case.
    I think Tim Miller is so damn frustrated with all that has happened that he just let it all out. I am glad that he did (actually found it quite refreshing to hear someone involved in this case speak what they actually felt). Was it a wise thing to do? I don't know if there will be other repercussions than getting donations for TES. I do hope he will change his mind and come back to Florida if necessary.

    I must say he book idea has been churning in my head for some time now,stpetesmj, but whether I'll write one or not is still up in the air.

    I think a good amount of steam was blown because of the way the Anthonys treated Tim. It was as if they didn't appreciate his work. I can understand the Anthonys not wanting to believe Caylee was deceased back then, but still, he spent a lot of time and resources in this state between Caylee and the nut baskets running around in Putnam County. Oh yeah, that's right, the whole lot of them are in jail now.

    Tim Miller is the sweetest man. And, to have the Anthony's slander him, is disgusting.
    The video you showed was quite interesting, as to his feelings towards the family.
    Good for him. With all the good he does for others, he deserves a lot more respect. Such a dedicated man, suffered his own loss and now such a crusader for all of us. Amazing human.
    Brad Conway quitting on the Anthony's is not surprising. Why did he wait this long?
    Baez does not stand a chance defending Casey at trial. He is nothing more than a media chaser.
    How sad! All the money from the Florida taxpayers providing for this worthless woman - Casey, is quite upsetting, and I don't live in the state.
    It is unfortunate, it is law, she gets the rights, as other citizens. What a system.

    Good morning, simba - I changed sites for several reasons. It looks more professional, for one thing. I have a lot more creative license. I can use CSS code if I choose, which means I can build the entire site in Dreamweaver. It's not a free site. Because I pay for it, I get a lot more bandwidth than a free site like WordPress. This speeds loading on your end. Of course, since this is a lot more complex, there's a learning curve, and it will be a while before I understand the complexities.

    Just never got into following the internet advancements. And, there are many.
    I check Hal B., Florida, but try to to be careful with other sites.
    He has some good follow-ups and links. Try to keep the computer safe.
    But, you are still my favorite. Your writings are so sincere and appreciated.

    Hi everyone! Great read again Dave! I have a mere few comments...
    First of all, I am not at all surprised that Judge Perry allowed this access to the Defense... First of all, he needs to eliminate the possibility of appeal due to bias. Secondly, the way in which Judge Perry made the ruling, states that the Defense must bring forward names to the judge before anything else can be released. The Defense needs to dot their i's and cross their t's before they elect to use a volunteer as a possible suspect or murderer. Remember the Defense's own words, and Cindy's, "Just because she is a liar, doesn't make her a murderer". I am inclined to believe that all this "play" on volunteers is just another way of trying to "sway in" the jury. But, what I also think, due to all the other "bus accidents" by the Defense, that the good people will see a pattern laid in asphalt that leads yet to another dead end. The longer someone (Defense) continues to lie, the less likely people are inclined to believe or even really "listen" to them. It is one thing to hear and another to listen too. An example for me would be, even if Casey elected to tell her side of the story, I wouldn't believe most of what she had to say. Even if an "accident" was the initial cause of death, the fact of the cover-up would proceed the feelings of sympathy for this "mother".

    As for TES, I completely sympathize with them. And...btw, I completely agree with his thoughts on the Anthony family. I have always believed from day one when they refused to help him find Caylee either alive or dead that they already knew what had happened. This family has caused more harm than good, not only to Caylee but to all the other missing children and their families AND to all the volunteers and people who have donated money, supplies and other resources. They have completely defaced w/o conscience those people who have put so much time and effort into finding Caylee. Although this angers me, I also believe that this will also be their downfall in the end. The forensic evidence is much more informative and reliable than anything that the Defense or the Anthony family can ever say or do to convince me otherwise. The "experts" that the Defense has hired do not impress me either. World renowned or not, anyone hired by the Defense team gives me a shy eye due to the Defense's lack of integrity thus far.

There are times when I have had so much to say but didn't want to overstep the boundaries and jump in before Dave or yourself had time to make your posts. I enjoy reading everyone's comments. I have gained a lot of insight from so many different perspectives. To this day, I continue to research to try to find alternative thinking and beliefs of Casey's innocence but have yet to find a comparative site that can provide possible answers to the most important questions.     Have to say Tim Miller did not pull any punches about how he feels about all this. We are not left to judge him from what we just would "think" he would say, and that is good. When you have time Dave, can you refer a little to a few questions I have, it has been a while. Did Padilla come in first and look for a dead Caylee. Did Tim Miller come on the request by the Anthony's to look for a live Caylee, after Padilla, because if he came under that request and immediately stated to them Caylee is dead then I can see where Cindy being Cindy told him to leave. I also understand that she was rude, because she wasn't paying for anything. So that being said, another question I have is did Tim Miller ever experience the odor in Casey's car. Did Padilla? AND since there has been accusations that someone else put Caylee's remains where she was found after Tim Miller was there, whatever happened to the story of someone reporting seeing one of Casey's description coming out of the woods nearer the airport. Did that prove to be a lie. I am thinking that if it were true, could Casey herself had Caylee there first. I read yesterday someone is hitting on the 17 -19th of June that Caylee was in her car. That is three days, could the decomposition have been so bad at that time, then the date Tony Lazarro did not smell it when helping Casey with gas. Do you have the date for that. Please. The only out I have for Casey in my mind it to allow for Caylee dying accidentally from having been sedated too much, that of course still leaves Casey responsible. Are you still leaning to her going back to the house on the 16th and either killing her there or to tape wrap and stuff her to be discarded. Too much too soon to ask? Thanks

    Ice, There are blogs, or at least one blog, out there that is Pro Casey, for lack of a better word. Do you remember that guy, James something, he was always trying his best to make us see that yes indeed Casey was not only innocent but Caylee was alive and well in some place in, maybe upper state NY, PR or wherever. Anyway, he comes every once in a while to pitch his plea to us and then he leaves and comes back again. I am sure Snoopy can find you the right place. Good luck.

    Yes Ice, that is right James (middle initial) McIntyre. Not reliable at all IMO. Since the remains of Caylee have been found and DNA has proved it, I think he is way off base in a lot of ways LOL. But he is nice, does not say anything to us, just posts his thoughts or his "proof" for lack of a better word.

    I do not think there is any evidence to prove or even suggest that Casey is innocent. There is just so much out there that says she did murder her baby. And when you put Casey's relationship with her Mother and the way Cindy treated Caylee, not getting to party all the time (like she did after she murdered Caylee) you have the makings for someone who was jealous of her daughter and she needed to go.

    IceMistress~~there are a couple of blogs out there that are pro Casey. Now whether they really believe that she is innocent is debatable. I tend to think sometimes they just want to be controversial. You can state facts that are in the documents and they will twist and turn those facts around to suit their own purpose. They only view one side of the picture and that is Casey did not murder Caylee and will not entertain anything that would indicate Casey is guilty.

    In the beginning, I tried to keep an open mind and study both the pros and cons. As time went by and more info came in, I had to lean towards guilty, There is a blog listed on the front page of Wordpress-Casey Anthony. I would rather not put a link to it as, frankly, I would not send my worst enemy to that particular blog.

    While scooting around the few blogs that I frequent to just read, I came across something that caught my eye. A particular commenter who seems to make qutie a bit of sense, thinks that the defense may be looking for Joy Wray's TES record. Could this be a last resort for the defense to try and implicate Joy? I can believe just about anything now.

    Ecossie~~finding that audio is like trying to find a needle in a haystack. I remember it was some noisey and Cindy did most of the talking. She went out to lunch with someone from LE. If you recall the name of the one from LE, it will make it easier for me. I cannot recall off hand what Cindy said about Texas Equusearch but no doubt she was complaining about something.
