    Interesting day of discovery

    More documents were released today concerning the investigation into the death of Caylee Marie Anthony. Some of the discovery is not very revealing, while other documents are. For instance, several TES volunteers described receiving phone calls from private investigators stating they were “calling from the Orange County Courthouse.” While misleading, they were not illegal. Cpl. Yuri Melich wrote in his incident report that an “investigation was conducted in order to determine if a private investigator working for the Casey Anthony defense violated State Statute by falsely impersonating an officer as per Florida State Statute 843.08.” He added that “there is insufficient evidence to prove anyone violated this statute.” Yes, several people complained the callers had misrepresented themselves, but by merely saying they were calling “from” the Orange County Courthouse failed to constitute probable cause that a crime was committed. I have to agree. I’ve made phone calls from the courthouse and by merely telling the other person I am calling from that location reveals nothing. I could be there for a hearing or something else.

    What I did find interesting is that, while a lot of people believe Jerry Lyons is working alone, or that Mort Smith is still somehow involved, two new names surfaced. AHA! We can now add Katie Delaney, Gil Colon and Scott McKenna to the list. What would be intriguing would be if the SAO decided to seek the cell phone records from all of the PIs to see if they really did call from the courthouse as they claimed.

    Julie Ann Davis

    Julie Davis was a TES searcher who was a K-9 handler. Her dog was trained to find human cadavers. She searched the Suburban Drive area on September 7, 2008 along with Tammy Dennis, Karen Gheesling and Luther Peeples. Tammy Dennis was also a dog handler. None of the dogs alerted anyone to a body. She was clear in her memory of where she searched, and more signifiacntly, where she didn’t. She said she looked at the end of Suburban, across from the school, with her dogs. So did Tammy. They found nothing unusual. She also said she looked into the wooded are where the body was eventually found, but not with her dogs, that remained in her car at the time. Those particular woods were overgrown with brush and flooded, she told Cpl. Eric Edwards on February 3 of this year.

    “Um, I got out of my vehicle, walked along the edge of the, the tree line there. Looking inside that vegetation ah, it was thick, but I could see through the thickness was a lot of water.”

    One of her most significant statements she made was that it may have been very difficult to find a body. Many variables would come into play.

    “It depends on the body if it was wrapped in bags whether or not that K-9 would be able to detect that.”

    Cpl. Mark David Hawkins

    Mark Hawkins was a longtime friend of Casey and her family. She often talked about visiting him in California, where he was stationed as a U.S. Marine. He knew her from their high school days together. After finding (alleged) samples of human decomposition, samples of Caylee’s hair and chloroform in the trunk of Casey’s vehicle, Hawkins came forward and offered to help in the investigation since he had knowledge of the victim and her family. He admitted that his relationship with Casey was only plutonic; that they had never been sexually intimate together. He said that they both agreed that they should just remain strictly friends. He was in the military and constantly being sent to different locations. Casey said she didn’t want a transient life for herself or Caylee.

    “In late June/early July 2008, Casey and I were talking regularly, as I was keeping her updated on some medical issues of mine. She was worried about me and stated she wanted to come out to CA to see me, although there were never any solid plans made. A week or so later, Casey called me and was noticeably upset nd frustrated. She said she had something to tell me and couldn’t say it over the phone. She said ‘something happened’ a long time ago, but wouldn’t say what it was. Casey said she told her mother and brother whatever it was and they became angry & frustrated about it. I asked Casey what happened and tried to get her to tell me, she just saind, ‘Hey Mark, it’s just something I want to tell you in person’. I thought maybe there were some issues between her and her father or thought she was possibly upset about something else and she was just sort of dancing around it.”

    In my opinion, this could have been the start of her accusation that her brother used to molest her. NCIS, the U.S. Naval Criminal Investigation, sent Supervisory Special Agent Leroy Jethro Gibbs and Probationary Special Agent Ziva David - JUST KIDDING! NCIS sent Hawkins to Orlando where he agreed to be wired up by FBI Special Agent Steve Mackley. He met with Casey at her house on October 9 and 10, where she was under house arrest after Leonard Padilla bonded her out of jail. Casey never did make admissions related to the death of her child, although this was prior to Caylee’s body was found. Casey also told Hawkins her brother, Lee, knew most of the story about what happened to Caylee. She added she would tell him all about it one day. I doubt Lee was in on the murder, though, and he was never a suspect.

    Anne Pham

    Anne e-mailed Yuri Melich on February 1 of this year to tell him that on the morning Caylee’s remains were discovered the two of them spoke over the phone as the news broke. Laura never said anything about searching that specific area of Suburban Drive. In fact, it wasn’t until weeks or months later that she started claiming she searched there. Pham continued by saying that other searchers had no idea about Buchanan’s claim. Buchanan thought Roy Kronk was somehow involved in the murder of Caylee.

    Dr. Barry Logan

    Dr. Logan is an expert in toxicology and analytical chemistry for NMS Labs. He has been retained by Casey’s defense.He will argue that there is no standard operating procedure for the use of the equipment utilized by Oak Ridge National Laboratory. He also states that the database was established with a total of four cadavers buried underground. There’s no demonstration that the findings would apply to human bodies that decomposed under different circumstances, such as in the trunk of a car. As an expert witness, he bases his opinions on several factors, one of which is that Oak Ridge is not a forensic laboratory, nor is it ASCLD-LAB qualified.

    Dr. Timothy Huntington

    Dr. Huntington concluded that the species of fly associated with the garbage bag in Casey’s trunk is unremarkable and of no forensic value. Also found in the trash was a single dermestid beetle larva that’s of no significant value. Of course, he acknowledged that the findings were open to revision and reinterpretation, but we are now seeing what some of the defense witnesses will testify to at trial. He continues by claiming that, given the conditions in the trunk, specifically increasded temperatures due to solar radiation, adult flies found in the trunk on July 16, the eggs should have not been laid before July 2. Of course, the two sides will be arguing over the insect evidence at trial. Big time.

    In a minor setback for the defense, DNA tests on a laundry bag and shorts that were found with Caylee’s remains came back negative. It may have helped raise reasonable doubt.

    Depositions

    Several depositions were released yesterday. One that was filed comes from the Orange-Osceola Medical Examiner’s Office, where Dr. Jan Garavaglia works. In her September 28, 2010 deposition, she confirmed that the remains showed no signs of trauma. Nothing led up to the cause or manner of death. When defense attorney Cheney Mason asked her about other possibilities besides murder, such as playing with a plastic bag or drowning, she replied that because nothing was “reported immediately to the hospital or law enforcement to try to rescuscitate this person, or EMS, and this person is still found with duct tape on the face, I would still call that a homicide.”

    I know many of us have already heard that revelation, and we may remember what Kiomarie Cruz said, too. Another deposition came from OCSO Deputy Appling Wells from his March 9, 2010 deposition. Kiomarie told him that Casey “didn’t really want the baby” and that she wanted to give it up for adoption. Cindy wouldn’t allow it.

    Wells met with Cruz on July 19, 2008. She and Casey were friends from middle school and high school and they used to hang out in the woods across from Hidden Oaks Elementary School. She told wells that they used to go there to do adult things like fornicate and smoke wacky weed. “If Casey was to do something bad,” she told him, “maybe this is where she would put the baby.”

    Jose Baez questioned him about Kiomarie’s mental health and Wells said, “I didn’t think that was an issue talking to her.”

    Wells said that after Casey was first arrested, she was shocked and most likely “a little pissed off.” 

    He discussed meeting with the Anthony’s neighbor, Brian Burner, about the time Casey borrowed his shovel. “She brought it back an hour later,” Wells said. “Nothing stood out as far as being something wrong.”

    Later, he had a “police officer to police officer” chat with George looking for evidence that “someone, something had been buried” in the back yard.

    Finally, and some in the media may find this a bit unsettling, Wells expressed his annoyance with the media throughout his deposition. He considered them to be obsessed with the story.”They’re just vultures,” he said.

    Even though the PI's said they were calling from the Orange County courthouse, I think they were being deceptive. I think they were on a fishing expedition just like JP wanted to avoid. I feel for those people that volunteered their time to help search for Caylee and didn't want their personal information our there, and now it is. Just think of all the money that has been spent on these PI's to make all those calls to people that didn't even search or search that area. If JP gives this defense team anymore money for PI's he needs to take a look at exactly what they are doing with it and how they are doing it. If he saw these latest documents I can bet that he would not be too happy with this defense team. They are very sneaky and I can clearly see how they can get someone to talk to them and how they like to twist those people's words. I now see how they were able to get you to talk and twist what you had to say. I am glad that they were investigated and it is too bad they didn't have more evidence to prosecute them.

    Telling a lie incorporates lie-ability! Astute observation Dave, hope they request those cell phone records. May not be illegal to state "calling from courthouse" but it fits my definition of prevarication...deliberate act of deviating from the truth. The lies continue, I'm reduced to drivel concerning the tarradiddle of the defense private investigators. Keep up the good writing, luv ya blog!

    Hi Dave,
    I never knew about you or your blog until the entire Judge Strickland fiasco, even though I've been interested in this case since Day 1. Now, I can't wait to read your blogs and always look for you in the courtroom when the motions are televised.You do a wonderful job and I thank you!!!

    I lost my job in September 2008 and I believe it was November when I joined Equusearch on a Sunday and spend the entire day searching for Caylee. I came home feeling that it was the most beneficial thing I did since losing my job. I am amazed at this case and have been from the beginning. Especially since I live close by (Oviedo), have a grand daughter Caylee's age, and at my old job was able to get some flyers donated at the request of Child Rescue Network.

    Several weeks ago I got a call from "Orange County Courthouse", wanting to know if I searched on Suburban Drive (our group was no where close) and I said no. After I hung up, I thought, "it never occurred to me to ask if that question was on behalf of the prosecution or defense."
    Now I have a better understanding of who was asking me that question. So, even though we searched miles from Suburban Drive, my information was still out there and I still got a call.

    Thank you for your incredible insights!! So many people like me are out here - we read your blogs, wonder if all is well if nothing posted for a few days, and very slow to let you know how much we appreciate all you do!

    I'm sorry you lost your job. That hurts, but it was very giving of you to join TES to search for Caylee. I'm sure you felt like you helped because you did. Plus, you managed to get flyers printed. You are a kind and generous person.

    I think it's almost comical that you got called by the "orange County Courthouse". Probably because you live nearby because records didn't show you anywhere near Suburban Drive. At least you didn't complain. That would have put your information in the public eye. I can understand now why some people would never do it again, or not in Florida, at least, where everything is out in the open.

    Thank you again. It's nice to know you are out there. As the case gets closer to trial, there will be more to write. It's really nice to know you care, too. Please make yourself at home and say hello anytime. It's always great to hear from people!

    DAVE: As always thanks for giving us that information on the two new faces. There are so many players that it's hard to keep it all in line. I don't know how you do it? What would the Defence be trying to elicit from these two? How would it support or more likely confuse the jury?

    Hi Weezie - There are so many people involved in this case it's unreal. It does get confusing at times, but I've got great friends helping me. As for the defense, I can't figure them out at times.

    Thak you. I'll let you know about InSession and how to watch it on TV, but I'll bet my bottom dollar there will be live feeds all over the Internet.

    M.J. I was thinking .... that's a laugh in itself! Isn't IN SESSIONS HLN? If that's the case I get it. Or if not I can order Fox or MSNBC. If anyone knows if any or all of them are covering the courtroom, I would surely like to know before the trial so I can get my channel watching ready. I was going to set up my computer screen to face my couch (no laptop at the moment), and set up my cordless mouse so I could click on the steaming bar that seems to pop up every 4 minutes or so. LOL. What I am willing to sacrifice in order to see our little CASEY get what's likely coming to her in the name of our dear angel Caylee.

    I haven't read through all the documents, so your summary helped me out a lot today. Thanks Dave.

    Ok anyone with an ounce of common sense would realize there is absolutely no reason "the Orange County Courthouse" would have to call them. I'd be curious to see what the caller id on the phones had to say. Did it say "Orange County Courthouse" Annie? If that's so then I can visualize that investigator sitting on one of the rare public phones in such places because that's the only way it would show up with that name. Unless this PI got a secretary or something to let him use their phone, then he would be tying it up.. not probable. I am so sorry your info got out there Annie - it's happened to me so often my relatives ask how long this one will last when I change the phone number yet again.

    Weezie "In Session" is a part of CNN online. There is just a blog and that's it as far as I can see so far. The Tv news stations online WESH and WFTV will probably stream the trial online. That's where I watch. Here is the link for the In Session Blog.

    Once again I have to say the one thing Baez did right was tell Casey not to talk to investigators and the one thing she did right was listen to him on that one point. It's left it all in the prosecution's hands and what they have they got with no help from her.

    That's what I'm here for, Connie, to summarize and make things easier to digest.

    Hi Dave,
    I think you are quite correct about the beginning of the molestation allegations. Page 11 of the 119 page document dump indicates that Mark Hawkins was debriefed by an agent named Mackley from the FBI Orlando Sexual Assault Task Force after his October meetings with Casey.
    Sadly, I think these molestation allegations were made to stray males in Casey's life in a bid for attention and sympathy so prior evidence will exist on the subject. But it was all lies and just another way for Casey to manipulate men.
    Much like the Brandon Snow pregnancy drama - fiction for attention. A party isn't the place to air your grievances about something that private unless you're looking for both drama and attention. Whatever else Casey is, she of the stripe that believes any attention - positive or negative - is good.
    Casey has been one sick chick for a very long time. I completely get why Cindy couldn`t or won`t see it but George sure did. Must be ripping his guts out now that he didn`t overrule Cindy. I think the guilt about not saving Caylee is what`s driving his eleventh hour defence of Casey. Feeble as it all sounds to us.
    I believe the most significant revelation is from Mark Hawkins is his evidence that Casey had started using Caylee as a pawn in her war with Cindy and George in the MONTHS before the murder. Buttresses the argument that Casey was in planning stages for something back in March during the computer searches. I wonder how long it took her to figure out that killing Cindy and George in self-defence wasn`t going to fly.
    However, there`s now a straight line between Casey`s eff you attitude towards Cindy, her use of Caylee as a weapon in her war and well we all know how it ended.
    What is fascinating is that Casey is bold and defiant enough to kill a two year old girl, mother of or not, to punish Cindy and George yet meekly goes along with Cindy from Tony`s apartment. Cindy didn`t have any rights to Caylee, Cindy had her car back and you would think anyone that defiant could manage a if you don`t mind too much I won`t be going anywhere with you, thanks anyway. Weird.

    You're right about Mackley working for the FBI Orlando Sexual Assault Task Force. It must have been the start of her spin. I must say I agree wholeheartedly with you. She was eliciting sympathy. I guess she hopes it may be a way out of this mess. She was molested. I certainly don't buy it, especially alleging her father was in on it.

    Casey is sick, alright, and as self-centered as they come. What's so sad is that her mother never saw it and she wouldn't allow George to do anything about it. He's got to be highly frustrated. That Casey would use her daughter as a piece of furniture is beyond belief. Just shift her around and use her as a weapon against her parents. The whole thing is a complete tragedy.

    This case will go down in history with the most liars. From the star witness and family all the way down to the pis. What a disgrace. It just goes to show you not many people really care about the deceased child on the defense side of things. At some point it would be nice if someone could point out to Casey and her entourage what happened to Caylee was heinous. Maybe they should try owning that and prove Casey to be that great mother they claim. And then maybe a jury will buy her bull shit. I would not, but she may get lucky.

    Weezie..I watch the Casey court happenings at www.cnn.comlive It is great as there is no bufferind and no commercials...Believe me I have watched all the TV sites, WESH, WFTV, Click and any other active site I can find and cnnlive is the best...In Session comes on TRU TV so you have to have cable to get it and it is only on from 9AM to 3PM EST, whereas the cnn site covers the whole kit and kaboodle...By the way Dave...Great job as usual..I know this case has been a headache, just wait till the claws come out during the trial...I've ordered a BIG bottle of Execedrin just to get me through it

    Thanks Dave,
    I detest Cindy Anthony but certainly expect her to sit by the defence and stand by her daughter. Particularly with the death penalty on the table.
    I think Cindy understood a lot more than she will admit. When you have a lying thief under your roof the rose-coloured glasses tend to come off. Hence the counsellors.
    Nevertheless, in a thousand years would I expect her to make the leap to the realization or even suspicion that the next step for that piece of work that was her daughter would be the murder of her granddaughter.
    No mother or grandmother, in the absence of any sign of prior abuse, would go there.
    Even in light of all evidence to the contrary it would still be very difficult to let your mind even think it. Let alone know it. You would either have to blank out reality (she isn't even dead) or deny it (if Caylee's gone, it was absolutely not by her daughter's hand). At the very worst, the horrible aftermath of an accidental death. Kind of understandable to me.
    Perhaps Cindy's mind is simply protecting her from a complete breakdown. The brain is good that way.
    I realize Cindy knows George was as morally bankrupt as her daugther and she's still with him for practical reasons. Cindy is a world class rationalizer/justifier and a queen in the area of situational ethics but I still circle back to whatever you think you're dealing with no mother's brain would go to murder.

    You know, EH, I've been pretty much singing the same tune for a long time now. I do have a post I want to put up soon addressing the family sitting on the defense side and my idea why they do. I'll do it when there's a lull in the action. I do think it's relevant, though.

    I was reading Mark Hawkins statements an he was a recepient of the mass text Caylee is missing Casey sent out on the 15th July.He instantly phoned hopespring to find out what was going on.Casey said to him Caylee was taken from her 31 days prior an added the WORST thing is Mark because I didnt report this for 31 days they are looking at me.Realy?Your Daughter has been kidnapped by a demented leson teaching NANNY an the WORST thing is that L E veiw you as a suspect..Also this proves Caseys knowlage of guilt because at that stage no one from L E had told her she was being loooked at in conection with Caylees abduction/dissapearance.This phone call was before the next days jaunt to Univesal.

    You know, ecossie possie, there are so many pieces of the puzzle out there, and the State is going to put it all together.

    I just finished reading the complaints about the phone calls from the private detectives and I had to laugh. One woman sent the email to both Melich and Kathi Belich of WFTV. She was going to make sure they got wind of it. I wonder why she never reported on it. Anyway. This person goes on to state that the defense was in violation of the joint stipulation agreement that all searcher's info was to stay in the office of TES and she said they loaded up cell phones with the phone numbers/names and carted them out that way. She reminded him that Judge Perry said he refused to let the defense use the list for a fishing expedition and that's exactly what they did anyway. (She wasn't even a searcher, she worked at the base). I have to wonder if they went in there and looked for one word - Suburban then just wrote down the name and phone number of everyone attached to it. They couldn't have checked the files or they wouldn't be calling someone who wasn't even searching.

    By the way, I like your answering the coments within the box, it's less confusing.

    That's a good question about why KB didn't cover the story. I'll tell you, those PIs are a sneaky bunch. I don't know if JP will look into it or not, but according to OCSO, what they did was not illegal. So far.

    Until I get a better commenting platform, I think I'll continue answering this way. You're right, it is less confusing.

    Good reporting, once again. Great writer. If "Court TV" is not available, the best link I found to follow the court session is WFTV on the Internet. They have some great links about the case. The trial is coming up quickly - the A's better be prepared for some horrible testimony, which will be devastating to them. It will be so sad for everyone. This monster mom should have done a plea deal years ago to stop all this heartache for all - and taxpayer's money. Well, will await your next blog. Thanks, as always. Stay healthy!

    Thank you, simba! The trial should be huge, and I'm sure there will be live Internet feeds on all the TV stations here in Orlando. Yes, there will be very graphic testimony. How the Anthonys will cope is beyond me. Yes, had Casey taken the plea deal, this would have saved a lot of heartache. But then again, this may even the score. We'll see.

    I plan on staying healthy as best I can. I'm going to be very busy soon.

    Now, here's my question- if Casey had told this Hawkins about something "bad" that happened a long time ago, and also told him that she had brought it up with Cindy and Lee, doesn't it follow that it alludes more to George molesting her, than Lee?

    Then this is the way I'll respond from now on, Karen. At least until I get a better commenting system in here, but that would mean losing all previous comments and I don't want to do that.

    I think that whatever Casey wanted to tell Hawkins was just another one of her fabrications. She knew he wouldn't ask Lee or Cindy, and even if he did, they wouldn't know what he was talking about. If she was setting someone up, it could have been either one, but especially Lee. Sure, he would "know" about it because he's the one that "did it" to her. Wink, wink. Then she told Cindy. Wink, wink. I doubt it was George she was hinting at. Why tell Lee? Besides, Lee was the easier target.

    Weezie- I am from B.C Canada and I have Bell satelite, and Its on court tv....i receive it, so it does come to Canada just not sure if you have that channel as part of your cable package

    Since you have been to that courtroom numerous times, can you please tell me if there are any signs about cell phones before going in? I notice several using them to text while the proceedings are going on. And, do you think Judge Perry will set some rules once the actual trial starts about gum chewing, chatting back and forth, and head shaking? Seems pretty relaxed right now. TIA ~Diana

    Hi, Diana, what a pleasure it is to see you. As always.

    Each judge generally has their own team of deputies in the courtroom. They keep a watchful eye on people in the gallery. Occasionally, they remind people to refrain from making faces and whispering. Last Thursday, the judge admonished people. Prior to the start of the hearing, and probably before the microphones are turned on, we are reminded to either turn our phones off or set them to vibrate only. The media personnel use text messaging to get their stories across, or they type on their laptops. One of the rules already set in place for the trial is that only a virtual keyboard can be utilized, like on an iPhone or iPad. No standard keyboards. That's so there's no clicking noises. When the trial starts, there will be other rules in place, but that's what we know now. I'm sure the judge is going to be extremely strict when enforcing his rules. I'm sure this includes gum chewing.

    Miss Brandy from BC: I did have Court TV, until Rogers changed the format. I used to watch all the televised trials in the States. So now I am not sure if IN SESSIONS is now covered by HLN? I guess I need to do some digging. Thanks for your info, so glad to know Bell TV takes care of their customers. Everything I use is on Bell excluding Cable, which is Rogers. There's too many trees in our backyard, that would block the satelight signals. hrmph

    Yes in-sesion will be covering the Anthony case but in-sessions plans to cover the Michael Jacksons Doctors case at the same time. HLN is part of the in-session group so from what I have heard they are going to have Nancy Grace do a majority of the Anthony case. UGH!

    HLN, CNN and TruTV are all part of Turner Broadcasting. TruTV is the cable channel. InSession is the program that airs from 9-3 M-F. All three networks have been known to cross over their programming.

    OK, now I am totally confused. I have never been able to get TRUE TV on my computer, so I guess you have to subscribe but I don't believe I have that cable option. Does that mean I will only see bits and pieces of the trial? or will IN SESSION be on HLN from 9 - 3? I kind of doubt it because of all the other hosts on the show...... I should write to MSNBC and FOX, to see if they will be covering the trial. Who knows about all these feeds and who picks up on them? Perhaps they are negotiating that right now. I'm in the DARK.

    Weezie, You can't get Tru TV on the internet. Tru TV is a cable channel that airs In Session from 9-3 PM EST. HLN is another cable channel that has JVM and Nancy Grace on it. I hope that helps you.

    Great post Dave ! I read here daily but seldom post. I received a call from Katie Dalaney a few months back. They called me at work I told her I was busy and would have to call her back. When I called her back she asked if I had searched with TES and if I had searched in the vacinity of Suburban Dr. Of course I answered no i did ask her who she was again and if she worked for the defense or the state of Fla. I live 1100 miles from Orlando. Although I do not regret joining that search , I met some wonderful folks, and saw some of the nastiness of George and Cindy in Jay Blanchard park. I am glad my group did not search that area.

    You mention in you piece that there could be reasonable doubt when it comes to the testing done on the bag and the shorts????? I dont think this can be utilitzed as "reasonable doubt" as any sane person, even if he/she doesnt know about DNA, would know that there was a lot of water, a lot of weather between that dates she went missing and the date she was found. If i am not mistaken Dr. G indicated that the bones showed signs of root growth which can not be explained away. And to grow in sure inconspicuous places should indicate a little more validity that the bones were there for quit sometime...JMO

    Also, no matter what, even a lame person would know that there is no "accident" when it comes fro the placement of duct tape therefore the only explanation would be homocide...JMO

    As for Mr. Hawkins, i too agree with the assessment that the molestation accusations were attempts to get attention, she is narcissitic isnt she??? :-)

    If the last money given to the defense financed purposely deceptive calls to the Equusearch volunteers I would think that Judge Perry would pull the plug. Doesn't Jose have to give him a verifiable account of every dollar of tax payer money he spends?

    Also, there seems to be an absence of people in the Anthony circle who are shocked at the thought that Casey could be responsible for Caylee's death.

    Totally heading out to left field with this comment because it really has nothing and everything to do with this string, but I'm going to say it anyway.

    You know, the sad thing about this whole mess is that in the end, whether Casey Anthony is convicted and sentenced to death or whether the defense can conjure up enough evidence to hit that standard of "reasonable doubt" to save her life, the fact remains that the truth behind what really happened to cause the death of little Caylee Anthony will never be known. Maybe I'm wrong, and maybe some how, some way, the prosecution has the evidence to prove exactly what happened, but I don't think so. Even if, for some Godforsaken reason, Casey Anthony decided she needed to confess any knowledge of what happened, she has already proven herself to be a pathological liar, and one couldn't even possibly begin to think that what she might say would be truthful.

    I'm a Mom Too ~~ you are exactly right so even if Casey decided to tell all, we would not feel that we had finally learned the truth. We will never know regardless if Casey is proven guilty or not guilty. In Casey's fantasy world, the Nannie or someone else murdered Caylee and she feels it was the right thing to do so Casey could be free. Once Caylee's remains were discarded among the trash in the woods off Suburban, Casey shut the door on reality and it will remain closed forever.

    I'm a mom too...Your comment is not off topic but rather something we all keep in the back of our minds when it comes to the Prosecution messing up cases that are handed to them in a nice, neat packages. Must we forget the OJ case? I've read SEVERAL articles on what the Prosecution never presentend that would have convicted him.

    Not sure how long you've been reading Dave's blog but it can be assured that there is plenty of evidence to sink her ship.

    B-Man I've been on the blog for awhile now. I don't tend to post often, I frankly enjoy the good read. Dave should get the spotlight media seat when this case goes to trial. His blog is honest, objective, educational and informative. I work in the legal field and understand the nuances of litigation and trial, and I give Dave HUGE kudos for taking the time and effort to educate the public with the layman's knowledge and understand of the intricacies of the case. I have never seen anything like this blog and he does an absolutely fantastic job and provides an amazing service (for free I might add - not much is free these days) to anyone wanting to follow along and understand. I'm certain this was why Judge Strickland would have followed.

    Hello Dave and the gang!

    Another great and interesting post Dave followed by thought provoking responses and a few Aha! moments for me. I didn't know the trial was so close....I mean I knew but forgot.(actually I thought it was happening in June or July) The aha moments are from seeing that other people think the same things I do - thus proving to myself I'm not really crazy! There's so many aspects of this case that never ceases to amaze me - one being the continual parade of new "characters" in this Shakespeare-Like tragedy. Its amazing how the list just keeps growing,

    One thought keeps gnawing away at me when I read anything about Baez or Mason. These men are educated attorneys, one has over 30 years experience. They've made blunder after blunder for the past 2 years, they've spent a quarter mil + with no results - partly because they wasted too much time & money on fishing expeditions which were ridiculous in purpose and intent and naturally resulted in zero support for their case - whatever the heck that might be...... these guys are all over the place. I cannot see any kind of clear strategy for their defense - while completely missing the ONE defense that might actually have a chance - not guilty by reason of insanity - and in the meantime they;ve
    shown us they can be just as disengenuous and sneaky as the defendent.

    They have to know that they are doing a poor job so my gnawing thought is WHY don't they snap out of it and get their act together? What is wrong with these guys? Do they think this is just a fame game? because that's how they're coming across. They act like children in thinking that even Bad Attention is good.

    Pippin, their problem (other than all the ones you cite!)- their huge elephant of a problem is that they have a stubborn and/or delusional client who has certainly lied to them, and the lawyer/client relationship can only work in a very serious case like this (dead child/DP state) when the client doesn't lie at all to their own attorney. They can patch together something somehow if they know what they're working with, they have been picking up various "tools" and whacking assiduously away at the case, but they just don't have the right tools to begin with. And I assume Casey lied/lies to them as she is pathologically unable to not lie- just because they are her Team doesn't mean they are exempt from her usual behaviors. No one was or is. I don't doubt that early on Jose reminded her constantly that someone in her jeopardy always needs to be upfront with their legal team. It seems that from her visitor's list they long ago gave up on that- she can't tell the truth literally to save her life. She wants full Acquittal and a brewski on a platter.

    I suppose you're right Karen but I'm sure they've known for a long time that she's been lying to them. They cannot shew away the facts of this case nor the character of Casey, her actions and other crimes after Caylee went missing, her history of lying, stealing, from friends and family, oh and her family too and how she was raised. Sheez! sometimes I feel the need for a shower after I read about them. Of course I don't mean her family are criminals but together with all of Casey's antics and the family baggage and the evidence - those lawyers can't possibly be that stupid to NOT know she's incapable of telling them one single truth. It sure as hell wouldn't take me even half of that to figure it out.

    Now with the trial coming up I'm going back and looking at older blogs that I didn't have a chance to in the past. There's just so much to know. I want to be able to understand everything that goes on during the trial. I still don't get why the defense team wasted so much time and MONEY on the volunteers who searched for Caylee. It's not logical because there was nothing to indicate that any of them did anything suspicious. It seems to me that in this fishing expedition they were hoping to find that one of the volunteers was actually Caylee's murderer and not her mom. But here's the thing - murder is messy, (yes it can be literaly-but I don't mean this in the literal sense) murderers always make mistakes leaving clues behind that in the end - shine the light on themselves. In this case that spotlight has been on since day one because of Casey's lies and the fact that she never reported her child "missing".

    And not because she lied but because her lies were so flimsy and her response to getting caught was to add more flimsy ones on top of them. I still can't get over the fact that she led the police to her old job knowing that by taking them directly to her office they were going to find out she didn't work there. Then there is the bizarre behavior, the physical evidence, etc, etc...

    Back to attorney's Dumb and Dumber...if the reason they went looking for a "suspicious" character or a suspcious act from the volunteers in order to throw the spotlight on one of them thereby giving the jury enough for reasonable doubt then wouldn't there have to be some kind of physical evidence to back it up? I mean even if they found someone was of questionable character that wouldn't be enough. They would need something to tie that person to the physical act of the crime and CLEARLY they did not have that. So what was the purpose of that very costly fishing expedition?

    This is what I mean by they're all over the place... what can possibly be their defense? They have nothing to show for all that money they've spent on these wild goose chases and yet.....they continue to do them while getting themselves in trouble with the judge for not complying with the things they SHOULD have done. At this point I seriously doubt these attorneys are of sound mind. Which of course adds more OMG! - moments to this tragic and sad "Comedy of Errors".
