    Another One Bites The Dust

    "With regret, I am forced to resign as George and Cindy Anthony's attorney. The defense motion filed on Aug. 9, 2010, contains allegations that are not, in fact, true. As an officer of the court, I cannot stand idly by knowing allegations involving me have been misstated. I am now a witness to an inaccurate legal pleading filed in our court system. As such, I cannot continue in good conscience as a legal representative. George and Cindy Anthony have done nothing improper, it is the failure of the defense to verify the facts alleged in their motion that forces my withdrawal. I will continue to support the Anthonys, will continue to attend hearings and the eventual trial, and most importantly, I will continue to search for the full truth regarding the killing of Caylee Marie Anthony."

    - Brad Conway wrote in his  letter of resignation

    George and Cindy Anthony's attorney, Brad Conway, will no longer represent them. The move is a result of a motion filed by Jose Baez & Company in the never ending dispute with Texas EquuSearch.

    First reported on the WESH-TV Web site, Conway appeared on the NBC Today Show to make his announcement. Regrettably, he said, he had to withdraw as the attorney for Casey's parents. On the network program, he claimed that the defense made false claims and he denied that he was granted full access to TES files. There were several misrepresentations, he added. He said he was given the same treatment as Baez and Cheney Mason regarding the roughly 4,000 pages of documents from TES volunteer searchers. Now, he feels he may be called as a witness for the defense

    Brad Conway has been a good friend and trusted counsel to George and Cindy. I've had several talks with him and he's an all-around good guy. I understand the defense fighting for their client, but this is one more glitch in the case. This team of attorneys has taken out one of the best judges in the Ninth Circuit Court, and now, Brad Conway. Believe me, I know precisely how they sting.

    There is much bad blood between the defense and Mark Nejame. To try to put things in some sort of perspective, New York City is big enough to handle lots of high-powered attorneys. Orlando is not. While Jose Baez is way out of their league, Cheney Mason and Mark NeJame are, next to John Morgan, two of the most powerful attorneys in this citified town we call Orlando. I am beginning to think there isn't enough room for both of them, and neither one is going to budge. Shades of Tombstone, this one may turn out to be a verbal gunfight in the courtroom. Call it the O'Casey Corral. Unfortunately, Brad Conway just got caught in the crossfire, and the bullets haven't even begun to fly yet. Who's next?

    Dave~~I just listened to Brad on the Today show. If I heard things correctly, Brad said that Mark NeJames forced Cindy and George to sign a waiver and in return, Conway was given access to those TES records. There is something really underhanded going on here. Waiver for breaking the attorney/client privalege between NeJames and the Anthonys??

    First off, I do not understand why Brad should be allowed to view those records. Did Brad get the courts permission to do that? I don't think so. I am now beginning to question Mark NeJames ethics in all this. I honestly think that both Brad and Mark have gotten themselves in a bit of hot water.

    I hope you take a moment and let me know if you can make any sense of what is going on with all these attorneys. TIA

    [I'm going to take a deeper look into this, Snoopy. I smell a rat of some kind, although I do not think the court placed restrictions on those files as far as outsiders are concerned. You think it would go without saying, but perhaps not. Brad says he was not given any more privileges than what the defense got, and I vaguely remember something about him being granted some limited access, but I'm not positive.]

    conniefl~~I am thankful that I learned html a few years ago. Once you put a code in, if you don't put the html in to break the code, it can continue into the next comment. I know using bold type can do that sometimes. Dave will make pros of us yet. LOL

    Dave~~one other little tidbit here. It is not a given that Brad will be called as a witness for the defense. He is saying that he cannot remain as attorney for Cindy and George if he is called as a witness. It seems his decision to make an exit is rather premature. This is making me wonder if he really wants out for other reasons.

    [I was wondering the same thing, Snoopy. I question whether we'll ever know, though.]

    Do you think if the Anthony's find out or chose to believe Baez over Conway, that he didn't have to resign or he won't be called a witness, that they will speak out about Conway? This could get interesting.

    How do The Anthony's, and their attorneys sleep at night knowing they all lie and conive? How can anyone in The Anthony family ever find peace or any type of closure to such a tragedy? They will stop at nothing and hurt anyone or do anything to help free a mother who has taken her own child's life

    Dave ~~okay, the waiver that Mark NeJames got the Anthonys to sign was to give Mark NeJames permission to represent Tim Miller without there being a conflict of interest. In other words, Cindy and George waived their rights to attorney/client privalege while Mark represented them. If this was Mark's way of being able to write a book re his time with the Anthonys, he is not going to come out of this smelling like a rose. NeJames is saying that the Anthonys cannot retract the waiver and negate it.

    I would like to know what Brad was looking for in those TES records and why. He was doing work that actually the defense team should have been doing. To my knowledge, Brad was not in the employ of the Baez Law Firm.

    I believe I heard Mason say in the press conference that the searchers for TES had no right to privacy.

    Hi Dave, Patti O from Michigan checking in. I am confused over the Conway thing so hopefully you can figure it out and make it clear. To me it sounds like he is objecting to what Baez is stating about him in regards to the TES records. How would this make him a defense witness if he's going to deny what they they are implying?

    Well, my friends, I hate to post and run, but it's been a day. Sarah has two masses on her brain, and her blood pressure keeps fluctuating, so no biopsy today. Her kidneys are functioning better, though, and that's good, but she doesn't remember what happened just yesterday. Today is all she can get through, and me too.

    I agree that there is much more to Conway's resignation than has been or will be disclosed any time in the near future. I wonder if another attorney will be crazy enough to take Cindy & George as clients. If I were an attorney, they couldn't pay me enough. And it's for darn sure I wouldn't do it pro bono.

    [Thank you! I believe an attorney will step up to the plate because of what the future could hold. Imagine that... book deals, the Today Show, FAME! Of course, whoever it becomes will say that had nothing to do with it. Other than that, lawyers naturally like to take on challenges.

    I just finished watching that news conference with Mason and Baez. Interesting and boring at the same time. The timing of this is what sounds fishy to me. It sounds like all this came about after the answering remarks by both the Anthonys and Conway when they were asked on national tv if they thought Casey had made a good choice in hiring Baez to begin with. They were both "welllll it was Casey's decision" - - then whammo, Conway resigns. They said Perry has granted them the right to review the documents, take notes with a magistrate handy. What changed? The magistrate - that's all I can think of. He gave them the ability to take notes after that last hearing.

    I think I can understand why Brad Conway was going over the search documents for the Anthonys. Remember at the time they were still looking for a live Caylee, not a dead one. I think he was looking to see if they overlooked any evidence of a live Caylee. The search changes when they go from looking for a live person to a deceased one. They might be thinking of suing TES for not finding the remains -- who knows?

    I have a feeling the defense didn't come out much better than they were before... Perry putting a magistrate in there to oversee should have been done from the beginning or at least when they started fighting over what they wanted to look at.

    Hi Dave Great post as usual. I guess Brad Conway would have left sooner or later...it is incredible everything in relation to Casey and her family is spoiled. There are some honest lawyers left...Mark Nejame at the beginning and Brad Conway now.
    At the end I am beginning to think that Casey deserves Baez and Baez deserves Casey...it seems that thery are both liars...even though I stil believe she must have a fair trial!

    Hi, Rita! What a pleasure.

    It sure does seem like everything and everyone who comes into contact with Casey gets tarnished, some worse than others. I sometimes wonder since there's so much hatred toward Casey, does it taint everyone who has anything to do with the case? I mean, there's so little trust for people around her, except for the prosecution. As for Baez, yes, they seem to be a match made in... well, it's certainly not Heaven.

    Reading what Mr. Conway had to say, and listening to the FBI tapes of Cindy at the same time 9I can only take her in small doses!!!)..I think that Conway is well aware of how misleading all the main players in this family are. ANd when Casey's defense team brought him ointo their game playing, he had enough of the whole thing.

    I think he knows more than we are aware, that he knows how this will play out, and he does not want to be part of the fallout afterward.

    Much of what Cindy says to the FBI is appalling, the efforts not to assist in finding her granddaughter, but to actually lead them away from Casey and toward her friends. I feel more empathy for those wh have been dragged into this, and their families.

    Interesting how Cindy keeps talking about "clues", how "nothing makes sense", and she wants the FBI to put their heads together eith her to make sense of it all. Yet she is directing them at each and every point..steering everything toward some crazy plot by Casey's friends..I believe Cindy may well be complicit..to the point that IF Caylee's body was moved, it was Cindy and/or Lee who did so. Did they hide her in the playhouse? Did they move her more than once (did they have knowledge of where the searches would be taking place the next day? It will be interesting to find out.

    Soo glad I am listening to the tapes, as tey make her position absolutely clear.

    On The Caylee Daily sight they say the defense is now trying to implicate a man from Houston and are stating Tim miller is covering up that Casey did not murder Caylee!!!! The info on whoever they are trying to implicate from Houston prob came from Cindy Anthony...Tim Miller is so correct in saying this family is the coldest family in America.

    Just when you think it couldn't get more insane, it does! I watched Tim's interview, and I am just devastated by the damages done to TES by the Anthonys. Did you hear that TES has had to turn down 25 families because of what the Anthonys cost TES? That's tragic! No one cares or expends as much as Tim Miller does in finding the missing and assisting their families! No one! The lengths the will go to in an attempt to excuse their daughter just makes me sick! Throw them all in jail, already, and get it over with!

    Hello Everyone: If this works, it will be my first correct link on Dave’s new blog.

    This is an interview that Tim Miller did yesterday, expressing his opinion of how Texas EquuSearch was treated by the Anthonys.

    I cannot get this to play in my area. (I believe it is blocked.) Everyone who has seen it, recommends it highly, (if you appreciate Tim Miller). Also the short video is apparently worth watching. I hope it works for you.
