Do I Deserve To Die Too?

When I was 23-years-old, I was arrested and charged with possession of a CDS and for being drunk and disorderly. I was with a good friend, who was also charged. CDS stands for Controlled Dangerous Substance, and in the mid-70s, that included… shake and shudder… marijuana. Holy catnip! The charges were way more than trumped up, and the arresting officer, Jack Demeo, was later fired from the Delaware Township Police Department in New Jersey and banished from ever being a cop again. Anywhere. He was bad news and a disgrace to all fine, upstanding law enforcement officers the world over. His downfall? He flashed his badge at an Atlantic City casino and asked for gambling favors and free drinks. He said he was from the NJ Division of Alcoholic Beverage Control.

The charges against me were dismissed before the trial began, but during a Motion to Suppress Evidence hearing, Demeo testified that he was professionally trained by the military to sniff out marijuana. Really? All that was found was one stubby, little roach — 2/10 of a gram — at the bottom of my friend’s ashtray. Had we known it was there, we probably would have smoked it that night and gone out for M&Ms. Skittles weren’t around in those days. As Demeo and his fellow officer traipsed us into the station, right across from where I lived in the blinking light town of Sergeantsville, I asked him what we were being charged with…

“Being drunk and disorderly,” he screamed back. Of course, we weren’t drunk and disorderly. My friend was dropping me off at home. We were minding our own business — sound familiar? As a matter of fact, the illegal substance — the killer weed — wasn’t found until we were inside the station and Demeo had a chance to run out to retrieve the vehicle’s ashtray, return, and dump it on his desk. “AHA!” he exclaimed as he sifted through the cigarette butts and held up the overwhelming piece of evidence. “I got you now.” 

Today, the whole experience is a joke, and I’ll be the first person to admit I smoked pot back in the day. But so did several of our presidents. Did they decide to start a war because they were high on ganja? Hmm… according to George Zimmerman’s defense logic, that could be the case. Think about it. George W. Bush. Barack Obama. Former pot smokers and warmongers. Bear in mind, there were no wars under Bill Clinton; not technically, and, in Zimmerman’s favor, Clinton never inhaled the stuff. Perfect evidence! Mark O’Mara and Don West may be onto something but, to be fair, impartial and to add a legal disclaimer, there’s no evidence that any president smoked marijuana while in office.

I haven’t smoked pot in 20 years, but 20 years ago, I was 40. I first smoked it when I was 16. By 17, the age Trayvon Martin was when he was shot and killed, I was a seasoned smoker, sometimes toking before, during, and after high school. I never missed a day of work because of it. 24 years later, I knew a lot about the stuff, although my interest had really waned by then. Mostly, I was a recreational user throughout the years. I was never addicted to it and it led to no other drugs. Today, it’s not considered a “Controlled Dangerous Substance” in most states, and some have even legalized its use. In my opinion, it was never dangerous unless you consider driving under the influence, but it’s nothing like booze. When I smoked pot, it was usually done with my friends, we were too lazy to drive anywhere, and we sat around listening to Moody Blues and Pink Floyd albums eating whatever food we had; like Cheez Doodles and 2-day-old pizza. The munchies. We chilled out. Never, ever, ever did we think about fighting among ourselves or with anyone else. All we cared about was was getting high and not allowing anyone to Bogart that joint.

Now, to the matter at hand. In the DEFENDANT’S REPLY TO STATE’S MOTION FOR PROTECTIVE ORDER/MOTION IN LIMINE REGARDING TOXICOLOGY, Donald West argues:

As part of the autopsy protocol, the Medical Examiner submitted Trayvon Martin’s blood for laboratory analysis. Among the findings includes a positive level for THC and its metabolite. The active THC was measured at 1.5 ng/mL whereas the metabolite was measured at 7.3 ng/mL. This level is sufficient to cause some impairment (although it is considered to be less than that required for a DUI arrest) according to the State’s toxicologist, Dr. Bruce Goldberger. […] Dr. Goldberger opined that Trayvon Martin may have used marijuana within a couple of hours of his death or that it could have been longer than that depending on whether Trayvon was a chronic user or an occasional user.

Was I a chronic or occasional marijuana user? You can only have an opinion — depending on how you think. Are you really qualified? If I smoked it last week, would I be too impaired to write this post? Bullshit. Here’s where the reply from West gets stupid, ludicrous and just plain idiotic. Remember, my disgraced arresting officer said he was trained to sniff out marijuana. In his defense, at least he graduated from the police academy and didn’t draw his weapon on me. Zimmerman, on the other hand, never graduated anything beyond high school. (See: Records show George Zimmerman got D’s in criminal justice classes.) The Defense reply continues:

In George Zimmerman’s non-emergency call to the police, he describes the person, later identified as Trayvon Martin, as appearing as though he was “on drugs.” Additionally, on close inspection of Trayvon Martin’s physical appearance at the 7-Eleven, where he was recorded on video within an hour of his death, he “sways” at the counter as if he’s under the influence of some substance. Taken all together, it is likely that Trayvon Martin was under the influence of marijuana at the time of his death and that his thinking and judgment were impaired at least to some degree. This is relevant evidence for the jury to consider when it evaluates Trayvon Martin’s actions that night, and the jury should be allowed to give it whatever weight it believes it should.

What makes Zimmerman and West authorities on drugs? It’s a complete joke! I’m trying to be fair and impartial, but I find this to be totally disgusting and disrespectful. 

Attempting to turn pot into a viable part of Zimmerman’s defense does make me wonder about something. Have O’Mara and West ever smoked the stuff? I mean, both are around my age. A few years younger, actually, but they most certainly grew up during the Hippie pot smoking era of the 60s and early 70s. They were young once, like me. I went to college. To say pot wasn’t on any college or university campus (including theirs) is a huge lie. Did Mark O’Mara and Don West smoke pot? Did it make them feel violent? I want answers. I want the truth. At the same time, West’s reply to the State’s motion is a paradox. If he never smoked pot, he might be inclined to believe it brings on violence. Smoke that war pipe. Yet, on the flip side — and in my opinion — West could have been as high as a kite when he wrote his reply. You can act pretty silly if you smoke too much weed, you know.

Some of you may argue that O’Mara and West are not on trial here. I have no right to ask a question like that. You’re right. But Trayvon Martin is not on trial, either. Obviously, Zimmerman’s defense disagrees and I understand the tact it is taking. They have every legal right to try it, too. I thoroughly disagree, though, and I think any jury would see right through this ploy if it’s allowed to be introduced at trial.

According to the defense team’s “disjointed” argument, I could, quite possibly, deserve to die, just like Trayvon. Zimmerman and West are self-trained to sniff out evil pot users and both have built in “high” detectors. The reply document says so. Yup, and pot smokers are violent offenders, but only in Trayvon’s case.

guilty lol in my day I could smoke you under a table, I dunno why but I cant handle it anymore. Its legal in Washington now even for recreational use. I dont have a prob with it but I hear its lots stronger now. People need to lighten up. I saw in Texas there is a person who is in prison for 75 years for selling pot. That is stupid expensive and not a crime IMO. They need to make it legal however it can mess you up like a bottle of vodka so the same laws should apply like the liquor laws

I seemed to have lost interest in the stuff. I don't know exactly when, but I just stopped smoking it. I wish I would have done the same thing with cigarettes, but that didn't come until 2007. Today, with all my health problems, I will NEVER introduce any type of smoke into my lungs again. While I had been saying all along that I might partake of the green stuff one day, I can safely say it isn't going to happen, although I will never say never to a small brownie. I do have to watch my sugar, though...

I was never a pot dealer of any kind, but I knew people that were. I don't know what the penalties are today; however, I do know that Florida is still a very strict state. Oh well, it's nothing I have to worry about any longer.

Right on Dave! I totally agree with you. I have yet to hear or read about any case where someone was smoking pot and went to commit a violent crime. Travon was walking back from the store not walking back from committing a bank robbery, break in or car jacking. He went to 711 and on his way home as I understand the facts. Since when is that a crime? With more states legalizing pot whether for medical or personal use I can't see as to where there's any argument except that it's still illegal in the state of Florida. I hope the prosecutor has a good deal of information on Zimmerman and is a bull fighter for justice in the courtroom.

[Just like the night I was busted, my friend and I were minding our own business. We were sitting right in front of my apartment and I was ready to go upstairs to bed. I will say this, though... Jack Demeo was a real cop. Zimmerman was a nothing. He should have minded his own business and left the job for law enforcement. He wanted to catch hisself a bad guy and he picked on the wrong one. Now, the Defense will attempt to tun it all around and place TM on trial. I think de la Rionda is going to fight this tooth and nail. We'll see what happens in the courtroom on Tuesday. Personally, I think she may allow some of the evidence, but that doesn't mean it's going to work in the Defense's favor a trial.

.Now as far as the "THC" reason for Trayvon's actions (swaying at the cash register and walking funny) Who doesn't shift one's weight while waiting for the clerk to finish up with the previous customer...I know I do it and it isn't cause of pot or impatience..Walking funny? I also do, especially if talking on my cell during the process of walking...I just can't walk straignt and chew gum at the same time!!! As far as toxicity goes, was "Z man" given a sobriety test??? Perhaps his actions could have been (LOL) the result of residual alcohol in his system...

Pot, Pot?? not too many folk around that haven't tried it..I have on several occassions and finally came to the conclusion that I'm allergic to it...All smoking it does is make me sick, headache and vomit....But Brownies, I can eat only one...

That swaying part is a joke. Heck, sober people have a tough time with the heel-to-toe road sobriety test. What would Don West do for a client charged with drunk driving? Throw in the towel? Look at how stoned Trayvon was! How could West possibly get anyone off with that kind of attitude? Zimmerman wasn't given any type of test, unfortunately, but that's the law. Self-defense, you know.

I don't know much about pot these days; i.e., potency and how many kids use it, but pot is pot and that's not going to change unless it's laced with other drugs. No one can claim such a thing because no other drugs were found in Trayvon's system.

OMG . I smoked my share of pot back in the day......and by the way, I didn't get addicted and I am................................ OLD. I always told my kids that I'd much rather they smoked pot than drink. How many people have been killed by someone smoking and driving? I haven't smoked in about 40 yrs and it didn't bother me a bit to quit. Instead of banning pot, they (whoever) should have banned alcohol. Couldn't have that though , they all drink...

Excellent post Dave. I smoked my fair share of weed back in the day and it was never a problem if I didn't have it. When I quit smoking it, I just quit. One thing is for sure, getting violent never entered my mind. In fact, avoiding confrontation was a must...Didn't want to ruin my buzz. Enjoyed a lot of laser light shows, pink floyd, named a few trees and ate a lot of brownies. But violent??? NEVER... O'mara has stooped to new level of low with this one.

Dave~~Since I have not dabbled in smoking pot or any other street drugs, I feel a little left out. You all make marijuana sound like the end all. Since marijuana was illegal at the time you smoked it, are you and all those presidents condoning that it was okay to break the law at that time? So everyone was doing it so it made it no big deal. I know my 3 daughters tried the 'weed' so I just finished speaking with one of them to get a bit of feedback. She tried it the once and said it made her paranoid. I also decided to do a bit of research and this is what I found. This info may be based on 'isolated' cases but here it is for what it is worth.

Studies show that violence can occur more often among people who use marijuana regularly, rather than those who use it occasionally or not at all. It is unclear why this is the case, but it may be because people with violent tendencies can also have a range of other psychosocial problems and are therefore more likely to use marijuana. marijuana is also part of the illegal drug market, which may increase the chances of violence occurring in some social interactions.

In addition, when people are withdrawing from marijuana they can be irritable, which can lead to abusive or aggressive behaviour.

Great read, well written. I do however have a problem when you wrote

Days after days, time after time, we have talked about this
way back within days this unfortunate night occurred. Never once have
I heard you being" Fair and impartial". There is two sides of the
story but I only hear you talk about one side. For me, I just can not
put blame on either side at this time. Nor do I favor one side over the other.
From your posts, you have found Zimmerman guilty. You just have

Hi, Dave - Great post, as always.

Trayvon's blood detected 1.5 ng/ml THC which is an extremely low count; even with chronic users, this indicates not having smoked marijuana for at least several hours to more than a day before he died. In other words, for people who know marijuana use only from Reefer Madness, he was not "high" at the time.

But, all this is irrelevant. A youth who ran away, a youth who allegedly hid before "attacking" Zimmerman (per Zimmerman and O'Mara), is a youth who sought the very opposite of violent behavior. If the event that allegedly took place at the T is discussed during trial, the defense will have a lot more to worry about than the prosecution; after all, according to Zimmerman's attested behavior and words, Trayvon had every reason to fear harm, and every reason to respond accordingly.

Despite O'Mara's initial reassurances that the victim would not be put on trial, he's using the sleaziest tactics to do that very thing, as well as attempting to prejudice potential jury members one week before a hearing, two or so weeks before the trial, and after the summons for jury duty had been issued.

It's doubtful that any of this material would be allowed as evidence; not only are bad acts not usually permitted, but this "evidence" doesn't even correspond to bad acts. Teens smoking pot? Flipping the bird? Holding a gun just above a table surface - not even pointing it at the camera? And none of this has anything to do with the events of February 26, 2012 when Zimmerman drove behind Trayvon; when Zimmerman said, "Shit, he's running;" and when Zimmerman got out of his truck and proceeded to hang about for several minutes in the very area of the struggle - time when he could very well have returned to his truck.

It'll be very interesting to see what the prosecution will do at tomorrow's hearing. Given that the information is already public, I'd be tempted to say to O'Mara, "fine, you can submit this 'evidence,' as prior bad acts, and, in return, we'll submit all of Zimmerman's previous behavioral and legal issues." A pot-smoking teen compared to an adult who worked as a bouncer, had had a restraining order against him, and accosted a cop. Oh, and a proven liar.

I watched HLN this morning, and I must say that the prosecution won today's bout hands down....I'm glad that a continuance was not granted,... At least we can expect this trial to start on time (if it's up to the judge)...I'm trying not to be partial eventho it is difficult after reading and hearing what we, the general public, have heard and read...I believe that one of the commentators said there is a 500 person jury pool...I wonder how long it will take to voire dire that many people...One thing for sure is I'll be glued to HLN for the entirety...Good Lord willing and the creek don't rise...

Without divulgeing to much Ive lived in my present adress 18 years its a rented houseing assosiation property.

As my wifed dissabled an bed bound I gave up work ten years ago to become a full time carer.
I ger assisted rent an other help includeing two heathcare nurses per week to help change dressingings ect flip an turn mattres,
As she has hospital bed hoists catheters ect,

Also alleged careres from agencys for one hour perday to also assist.

But in all honesty there a bloody nightmare.
untrained unmotivated minum wage an just a waste of space an more of hindrence than help.

An my own healths taken a turn for the worse seven years ago i was diagnosed with C O P D
A incurable lung disease.

I didnt smoke hadnts since age `30 an even then i only smoked weed not cigaretes however although Id given up smokeing .

Both me an my GP Doctor figured it had to be the cause.

Funnny thing was in my house an old Victorian mansion converted into 12 flats in the 1940s after the war.

Its a beutifull property huge back garden next door neighbour is a bowling green.

Its a property exclusivley meant for vulnarable persons due to age or ill health..

So turns out I start to realise that over 60 percent of residents all have serious chest conditions namely C O P D.

Although no one seemed to put this together.
Most if not all have differnt GP Doctors.

But i talk to all my neighbours as old people love to chat.

An then I discover some other shocking news purley by accident.

A contractor there on another job fixing a few loose roof tiles .

I made him an his workers alkl teas or coffees

An he remembered me from a job done about 8 years ago..

Oh yes I rememberd when the houseing trust put insulation in our ceiling cavitys..

He gave me a strange look .

Insulation he said .

Remember we were all wearing masks ect he said ?

Yes says I

Protect you from dust an fibre glass i expect.

No says he that contract was to strip out asbesstos from the entire property didnt you get told about it?

No we were told it was to install extra insulation.

Geuse what one of the major causes of C O P D Is.

An to top all that I went for a chest X Ray 6 weeks ago an I kind of glimpsed it as tech put it up agasinst a light thing.

An when i returned home my better half said well when will you get results?

Couple of weeks I dont know exactly but dont worrry I said I got a look at the x ray an there was no dark patches olr any thing it was mostly white no shadows.

She burst out crying as shes an ex nurse .

Whites bad on an x ray colin she said it should be dark.

Sure enough 4 days latter I get a phone call from my GP you have a large anomaly on left lung smaller on right report foe another x ray next day more thourgh an all angles this time.

An Im waiting for appointment for cat skan an biopsy basicly looks like Im flucked ....

As assbestos exposure also causes cancer lung cancer.

My self Im not worried as if i die im out of it an it holds no fears for me.

Im just desperate to make sure my better half an my babys Cats are well cared an provided for .

So if why when what we can prove thease fruckers negligent an responsable for mine an possably others chest disease

Then She should have a decent sum to live an ensure top care an nuirseing care round the clock.

So I may be distracted in the comeing months .

Its huge an to a three year old with his big brother takeing me to this strange place was unforgettable.

He basicy threw me into one of the sewage pools an legged it.

Luckily for me there was a workman there fixing a valve or something an he heard the splash.

Saw a dissappearing young boy an me in the water going down.

Its vivid till this day I couldnt swim obviously in 6ft of water sewege

Drowning going down sinking an pow someone grabbed me .

Pulled me up an I was saved he had dived in swum down an got me out swam me to a ladder an dragged me on the side.

I was in shock I suppose an both he an me looked like the creature from the black lagoon.

He sat me in his truck an drove to near by shops.

Someone ID me an told him where I lived an he drove me home.

It was the first time in my life id been bathed in the huge bath.

B4 was always in the kitchen sink.

Dave and I have bounced this around over the phone a few times but there is a HUGE hole in the theory that Travon was high and thus used poor judgment and attacked Zimmerman. Certainly, there are drugs that induce aggression, most notably alcohol. but here is the thing about drugs that do cause people to react aggressively. They -seek- confrontation. A drunk guy at the bar will want to "take it outside" at the slightest provocation. Yet what was Travons first instinct. It was to flee.

That Travon fled leads to me believe that he fought -only- because he was backed into a corner. If Travon is under the influence of an aggressive drug, he confronts Zimmerman when he FIRST notices he is being followed. Say what you will but nothing else makes sense.
