    Linda Kenney Baden calls it quits

    According to a WESH-TV news report, Linda Kenney Baden filed a motion in Orange County Court today to withdraw from the Casey Anthony defense team.

    She was hired to do most of the forensic work, but Dorothy Sims will more than foot the bill. My guess is that we are seeing Cheney Mason at work. He tried to cash in his chips at the courthouse in April, when he filed a motion for Judge Stan Strickland to step down. This time, he’s shuffling attorneys around. There is no doubt he is well known in Florida and the two newest attorneys to join the team, Sims and Ann Finnell, hail from Ocala and Jacksonville, respectively.

    No reason for Baden’s resignation was cited in the motion. Todd Macaluso resigned this past April stating that he is on “involuntary inactive status with the California State Bar…for an undetermined period of time.” Andrea Lyon resigned at the end of June. She blamed costs that the JAC would not pay, such as travel expenses.

    I would like to know which direction Mason intends to go. I am not sure that Judge Perry will allow Roy Kronk's past bad acts be introduced to try and cast reasonable doubt. That is pretty far fetched and alot of people look upon Roy as the good samaritan. Mason may take it to the end and try to get LWOP and claim it as HIS victory by sparing Casey from the DP. I still do not trust him and think he is looking for any technicality that will cause a mistrial.

    I think the Kronk idea originated from Baez. I think. If this defense points fingers at Kronk, that's totally barking up the wrong tree and Casey will feel the penetration of a needle in her arm as she's strapped to a gurney. There must be a more logical tactic. If not, bye bye Casey.

    Good morning Dave, I am still trying to figure out just what is going on with the Anthony case. Not that the attorneys are dropping out every day but there does seem to be a lot of them that left the case. I wonder how many bodies will not be there in May.

    The case seems to be at a stand still right now. I had hoped that once summer was over Judge Perry would have more status meetings and hearings on the endless motions that the Defense has made. I think the only thing that is certain is that the trial will start in May as planned. From what I can remember there is a hearing on Friday.

    It is good to be back Dave, I have missed you and all your posters. This week has been so busy for me, getting back from Texas late Tuesday night and then going to a retreat at church the rest of the week. It will be good to get back to some kind of normal. I hope you are doing well and that you too can get back to some kind of normal.

    I don't know about this defense either, but there is a hearing on Friday. As for being normal, yes, it is, except for the occassional flies that need swatting. You know, the usual pests. Other than that, it is great to see you here and there again.

    It's a very tame ghost, Peggy. She says she's Casper's grandmother, but there's no solid evidence of that. So far, it's nothing more than circumstantial evidence and it's not yet enough to make a proper identification.

    Dave, I would imagine that Friday's court hearing will be packed because Casey will be in attendance. How early do they usually open the doors for a 1:30 hearing? Do you expect that both Sims and Finnell will be there Friday or just Finnell along with Baez and Mason?

    Baez and Finnell both signed the motion for the money she wants, correct? Who do you think will do the arguing for the motion, Baez or Finnell? Do you expect that Sims will say anything in this upcoming hearing?

    Hi Dave~ May I say I think your a very AWESOME person! I love being able to see you in the courtroom when watching this case on TV. Thank you for being there :) I believe that Jose "Bozo" Baez didnt know what he was getting into in the beginning. Having to hire all the other attorneys is a proven fact that he cant handle this case. First off he isnt Death Qualified so there would be one attorney who he had to hire...as well as forensically speaking..I think he lacked in expertise. First off I do want to say this. Judge Stan Strickland is an awesome judge. I think that Cheney shot himself in the foot when he moved for Strickland to step down. IMHO... I think that Casey had a better chance with Strickland after all he did just charge her with 6 felonies instead of 13 and I think if Judge Belvin Perry had presided over those there would have been possibly many more than 6. Second of all Cheny maybe a good attorney ...but MY GOD IN HEAVEN...seems rather wierd that a retired attorney would step back into the limelight just because he likes to see how things play out. PROMISING?????? Casey has already told on herself by telling that Robyn chick that Zenaida didnt kidnap Caylee....The record will reflect that after the deposition Robyn is about to give. They need to get on with this case instead of all the putting off... I dont think Judge Belvin Perry is going to stand for much more monkey business...I like Judge Perry. I think his courtroom ethic are exemplary...and i know he possess the degree of fairness needed to go forward in this case. I am so ready for the lies to start flying. I have my DVR setup to record the whole trial....Thanks for letting me be a part of the best blog around ...and also may I say that from the beginning I have to agree with Judge Strickland...... you have the fairest blog around.... you held all comments at bay when it came to slamming the Anthony Family......now its all fair in love and war.....I SAY GAME ON!     Hi, Kim - Thank you for the awesome compliment! I think Baez knew he was getting himself involved in a huge case, one that would alter his life forever. He also knew he couldn't go it alone. That's not just because he isn't death penalty qualified, although the death penalty wasn't on the table when he was hired. As a matter of fact, she was charged with child neglect initially, and at that time it was not what Baez is facing today by any means. Once the ball started rolling and the 1st-degree murder charge was added, it took on a new meaning. Even then, in Oct. 2008, she wasn't facing death. That came in April of 2009, and with that came a lot more headaches. In any capital murder case, and Casey's is not unusual, legal experts come on board from all walks of life; all professionals in their own fields. A mitigation specialist, forensic experts in entomology and botany, and anthropologists, etc., to counter what evidence the state will present. Remember, as we question all of this as nonsense, the judge sits there and ensures that everything Casey's attorneys do is proper. He, more than anyone else, wants her to get the fairestv trial possible. It's not just because of appeals, it's because he doesn't want a person convicted who could be innocent. Judge Strickland was doing a great job, and with the recusal motion, it was no improvement. I'm not saying anything about Judge Perry. I mean the defense was hoping to get a more lenient judge. Instead, they got a stricter judge. Both are fair, but in the end, Judge Perry won't even flinch when he determines a just penalty if she's convicted.

    About Robyn Adams, remember, no one trusts a jailhouse snitch, and that includes juries. She might not even be called to testify because if the letters are ruled admissable, meaning they are authentic, then the letters will speak on their own. The trial will actually begin toward the end of May. On the 16th, a jury will be called and finally empanelled. Then, the trial will begin. I hope to make it to most of it, but as a diabetic, I may have a problem sitting in the courtroom all day, even with breaks. I'll have to figure all that out as it comes.

    Thank you for considering my blog the best one around. There are many good ones and we all sort of specialize in different areas. As far as I'm concerned, please continue reading. I will continue keeping the dogs at bay.

    Dave I think the Trial is due to begin on the i6th of May 2011 the jury selection process begins a week before on either the 8th or 9th.Could be wrong though.

    Hi All - I read over at OS - Hal Boedeker's article. I picked up on a comment from "OE". He/she argues that Casey is limited now to only "red neck" attorneys in Florida (aside from C. Mason) and that every denied voucher will be grounds for an appeal later on down the road. He/she goes on to say that "you either pay now or pay later."

    My question is this: Won't past precedent from other murder cases in Florida, where the accused were found to be indigent, set the tone for what Casey is entitled to? Why should she get different treatment? She's no more important than any other accused murderer. If she gets the exception to the rule, then every other indigent inmate can appeal and say they didn't get proper representation - right?

    Thinking about this latest Big Development- Casey's defense (according to LKB) was going to be a forensics based one. She said it over and over- the Guys could work the Kronk thing, or the TE thing, or whatever Thing they might cook up yet- but she was focused like a laser on "No real evidence" and "junk science", blah, blah, blah.

    Know what this means?

    At this rather LATE DATE- Casey STILL has NO defense! AAAGGHHH!

    Hi, nymima - I think anyone who would consider Jose Baez a redneck is not very bright. I've lived here since 1981 and I've never seen a Cuban redneck. I don't think this OE knows a lot about law, either. Motion denials go on all the time and as we all have seen, some of the ones filed by this defense had absolutely no merit. Imagine if attorneys did nothing but file stupid motions only to enhance a possible appeal. Every lawyer would file like crazy and justice would never be served.

    One of the things about this case over most other murder cases is that Casey is a star, whether we like it or not. She's a media sensation, albeit bad, but she's big news. There are no laws that restrict how many attorneys one can have, including free ones. This one attracts them because of the notoriety, for one thing. Plenty of attorneys work behind the scenes on other cases like this, but because there is minimal media exposure, unlike this one, no one pays much attention to what goes on. Granted, this one is special, but in any capital murder case, there's a lot more going on. The state wants to put her to death. She needs people to fight for her life. The JAC will keep tabs on how money is spent, and it's the same way for every other defendant - if only they could be lucky enough to assemble such a team. Hey! You never know. What's that old saying? You get what you pay for.

    Dave~...... Im under the impression that Crazy Anthony....has already been the exception to the rule. She has been from day one. The case is undoubtably the most nortorious of its kind.....and will continue to peak interests for years to come. Saying that Crazy and her family havent been treated with preferential treatment would be an understatement. If it were any other family I would think that some of the rather bizarre things that have transpired amongst the family members would be grounds for jail time! This family has gotten away with MURDER if you will and they will continue to get away with much more! It is just my own opinion....JOJO, SPINDY and TUBESOCK BOY know much more than they are saying. Its seems after listening to endless hours of depositions and reading the transcipts over again...( just to see if what I heard was what I heard) that there is so much more than what the SCAMTHONY's are saying. I know for a fact that my own grandson at 23 mos old isnt talking in sentences or he can run a DVD player or VCR for that matter. I will always believe that when Lee was talkikng to Crazy in the jailhouse video..........Crazy was talking in code.....She told Lee that she felt sure that Caylee was close to HOLT!........Holt being the nickname they gave to the woods where they used to hang out and bury their pets as kids. Crazy was giving Lee the whereabouts of where Caylee was placed after she killed her. Im not truly convinced that Lee didnt help place the body there. Also im not truly convinced that Lee didnt pick up Crazy's car at the AMSCOT and disgard of Caylee's body in the woods, then return the car to the AMSCOT. Whose to say he didnt???? There is still so much unfounded in the case.....I will be watching this case.....waiting for that guilty verdict......and hoping for more charges to be handed down........Thanks Dave!

    Well, Kim, a lot of it is speculation, like home, Holt or whatever. The issue of codespeak will be argued for years to come, and in the end, the fact remains the body was found close to home, whether that what she really said will have a bearing or not at trial. I don't think it will. As far as George, Cindy and Lee, their real names, two things come to mind. Because initial interviews with law enforcement and subsequent depositions early on in the investigation were transcribed, the state will hold them accountable for what was stated. We saw this going on at the hearing regarding admission of Cindy's 911 tapes, where both Cindy and Lee deviated from what they originally said. Linda Drane Burdick was very quick to refresh their memories. She won't hesitate to do it again.

    Because of stonewalling and fabrications, don't think OCSO isn't investigatiing Casey's family. Trust me, they are. There is a possibility they may be charged later on, but please bear in mind that they are going to be key witnesses for the state. Should they be arrested, jailed, charged and convicted BEFORE Casey's trial is under way? If you say yes, remember that their records will follow them into the courtroom next May. How credible are convicted felons?

    You know, Skat, I used to have problems setting time on VCRs. I sure am glad we have DVD/Blueray players now.

    Living in Florida, I've seen some of those impersonators. Some are good, some not so much, but most of them sound like lounge lizards, like bill Murray on SNL years ago.

    I'm wondering where BoxcarBob is- I loved his comments! I do think casual commentators "perk up" when something actually happens on the case, and start poking around again. Also, loads of people read and don't comment at all, but they see value here and at a few other places. We''ll likely see a lot of folks saying hi this weekend, after the hearing and Dave's post on it.

    I'm concerned about Katfish because her husband has been ill, and she was on crutches. I haven't heard much since, and hope all is well.

    As for the Blueray and DVD player, Dave, that went out when with PS3 came in. Got kids? Got gamers. Heck, Mom plays too!

    You're right about the lack of people who comment, Karen. There hasn't been much going on. There's been a lot of rehashing the hash. I'd like a better understanding of what's going on with Dominic Casey. Did he talk? Did he not? Is he still supportive of the Anthony's? Does Baden truly believe Casey's innocent? As her defense attorney she couldn't say otherwise. There will be much to discuss come Friday, regarding the new attorneys especially should one address the court. I'm not anxious to see Casey. She just nauseates me, at this point.

    Actually, when we mention a VCR, it usually means videos of movies. Blockbuster comes to mind. Today, we watch movies on DVD and Blueray formats. Netflix comes to mind, but for sure, I'm not a gamer.

    lol, Dave. The Playstation plays bluerays, so I only need to know how to work two buttons. YAY! I don't watch much TV, really. Since (chuckle) Al Gore invented the internet, I've been hooked on the wealth of information available that was never accessible before, and not even in a full volume set of Britannica! There's so much to know, and so little time if one doesn't have half a dozen life times, you know?

    Chuckle again. The kids and I have spent a great deal of quality time fishing, hiking, GAMING, among other things, and because I played I was considered the "coolest" Mom on the block! But of course, they'd always have to help me defeat the bad guy in the end. Gaming's a good escape after a really long or terribly bad day. Ask CaliPatti, she'll tell you! I don't know if I'm up to World of War Craft,or whatever it's called, but I'm giving it some thought. :

    Skat - I don't watch much TV, either, but I do like to watch movies on my laptop. I'm not a gamer at all, but I can play around quite well with Adobe InDesign, Potoshop, Illustrator, Flash, Fireworks and Dreamweaver, to name a few. That's a lot more fun to me.

    Yes, the Internet is truly amazing. Do salesmen still walk the streets hustling the Britannica? That's gotta be a hard cell these days, if there is such a job any longer.

    One of my best friends is 66 years old and he plays a lot of computer games, which just amazes me. As for hiking and fishing, yup, I enjoy that, and I'm considering taking up target shooting, just for the heck of it. I was always good with a gun, but I only shot one for sport.
